The way Lou Dobbs sees it, people shouldn�t need basic cable to hear him sound off at length on issues like immigration and free trade. Mr. Dobbs said yesterday that he was creating a daily three-hour talk radio show that would run in the afternoons and conclude an hour before his nightly program on CNN, which begins at 7 p.m. on the East Coast.
�My interest is in bringing a voice of reason, rather than the partisan and ideological poles that define talk radio right now,� he said in a telephone interview. Mr. Dobbs vowed that neither the right nor the left would be able to lay claim to him, with some conservatives who support his hard-line take against illegal immigrants breaking ranks with his opposition to free trade. �I consider both political parties to be tragic failures,� Mr. Dobbs said.

Thanks guys .... for coming behind me .. Shane Warne or Purple Haze won't satisfy you guys .. Y dont we discuss how Kanimozhi's discontent couldn't play spoil sport for the new govt and how Azhagiri got cornered with chemicals and fertilizers (these 2 are not any interntaional fame for an american 'tunnel rat' to know abt them).
Above all I am here to get some information to bring a company which violates rules to authorities, nothing more nothing less and not here to do any name calling of mud slinging.
Don't worry buddy.. I am sure these guys were only pulling your leg.
Yeah I am sure everyone should stand up against violations . It doesn't matter if it is done by Americans or Indians or any other national. Just because most of the L1's in this particular case are Indians there is no reason to turn a blind eye to someone breaking the law.

I believe that we will get 14-15K from EB2 ROW, EB1 = 12K (currently) + 6K (Minimum), regular cap I/C 6K. Eb2 row usage is down to 60%.
Total Numbers = 14 + 18 + 6 = 38K.
Now total demand is not just 34K demand data we also have porting and new filings especially from May - Jul 2007. My assumption of porting has been 6K out of which 2K have been approved.
So really its almost an exact match till Jul - Aug 2007. We should wait for the May bulletin thing to come true firts I believe VDLRAO gave a great calculation for that.
Don't forget EB5

I received a similar response to the 2nd SR. I was told that my case was under additional review and to allow them 60 days. However, my wife's case had been assigned to an officer for review.
Did you send an email to TSC.Ncscfollowup@dhs.gov (for TSC - another email for NSC). I had no clue where my application was when even 2006 cases were getting approved. I am seeing some movement after emailing them.
Did you get a response after you sent the e-mail? What movement do you see on your case?

What stops USCIS is the per country cap. They can only issue so many visas to EB-3 I.

I don't have H1 backup and already in 8th year. I am on self employment, But my lawyer suggested to apply H1extension (through my company) as a backup if MTR denied. If MTR are successful they I don't have to go on through H1 hassle again..

I saw this link Murthy's email too. The total pre-adjudicated cases in the chart is matching with the total in the document. Well now there are more un-answered questions:
1. Does all other pending 485 include employment based ? If yes what % are employment based ? Obviously we do not have any country specific data on these.
2. Is there any way to know whether individual case is pre-adjudicated or not ?
USCIS has fooled us again. No good statistical analysis can be done on incomplete/inaccurate data. I am going from hopeful to hopeless again. I am EB2-I Feb 2006.

This trend chart/volume chart certainly represents both family and employment base applications. Following is my thought process now with keeping both trend chart and teh worksheet in this thread chain together.
(1) In Worksheet USCIS claims total EB pending case 233816 by December 2009. Yet we
have not reached to December 2009. Trend chart claims total pending 279031
including family base applications. Since famaily to EB ratio is unknown I would
consider worksheet's figure as authentic for pending EB based 485 cases. One practical
clue for inclining to do this as I know USCIS has approved tons of green card in
parental family category. Many of my friends have got GCs for their parents in a
relatively very small time frame - 1 year
(2) I remember somehow that out of 775000 485 applications in October 2007, there were
around 300000 application were from EB category based on USCIS's published
notification ( I tried to find it on internet but some how I do not see it now). If
somebody has a more solid proof this stats from which we can derive nearly accurate
ratio we may consider those stats. But as I mentioned in point 1 USCIS seems to have
cleared more family bassed 485 with comparison to EB categories I would just
assume for now that 60% preadjudicated cases and "awaiting customer action"
and "New receipts" are from family category and 40 % are from EB category. Total
preadjudicated cases per trend chart is 178418. 40% of that around 71367 - for the
sake of easiness let's make it 71500. This way "awaiting cutomer action" cases for EB
categories could be around 18-19000. "New receipt" cases could be around 18000
roughly.
3) Now total EB based 485 cases by July 2009 could be = Pending cases + preadjudicated
cases + cases awaiting customer action + new receipts = 233816 + 71500 + 18000 +
18000 = 341316. Just the sake for simplicity in assumption we may consider total EB
based 485 workload with USCIS around 350000.
4) "In general" the first lot who will come out from this gutter is "preadjudicated" then the
lot "awaiting customer action" then the "pending ones" and then " new receipts"
Now based on my talk with USCIS guy I can state that USCIS generated RFEs innear past for many cases as apart of preadjudication process, particualrly for may AAC21 usage related cases - Asking for proof of employment in the same job classification. According to that talk if USCIS gets required response to the RFE then USCIS settle that case in a "preadjudicated" shelf. In other words the AC21 guys who got the RFE - responded and case is resumed - most of them should be on "preadjudicted" shelf. Here is another case of a person I came across recently. This person was stuck for the past 5 years in Namechecks . He applied for GC in 2001. He got his GC just recently after a long wait and struggle.

Mark's previous suggestion works fine in such scenarios. Do not mention the word "EAD" before hand.Do not mention H1 even. Do not try to even discuss EAD/H1 etc... As long as requirement allows Green card and where ever it is required for you to mention work status, jot down " Elligible to work for any US employer in USA". That would work. After interview, if they select submit EAD as a proof. At that moment they will not be able to deny that as a work status proof.
Note: Other thing I experienced is using the word "Work Permit" in place
of "EAD" makes things easy for everybody.
Right, we must avoid the word as much as possible. But then a lot of reqruiters and HRs now seem to educate themselves about the whole EAD thing and seem to be absolutely fine with the EAD.

People like you and boreal are doing much better because you decided that a 2 bed room house for rent is what you can afford because the prices shot up by guys like punjabi who wanted to make money and overbid on an house they cannot afford. Otherwise guys like you and many others would have bought house at a resonable price.
Don't you see what is happening? They live a rich man's life buying house that they cannot afford and then they foreclose with banks taking the hit. The banks in turn gets money from Governement, which they tax on people like you and many others who are renting, so that the guys like pubjabi are entitled to big house and bailouts. This is sick. Where is my bail out money. I want my rent to be subsidized too. I think boreal 's anger is real.

I have a question regarding this whole idea of filing on your own:
Whats the reason for doing this? Is it because:
1. Attorneys will be busy during this time
2. Employer will not file 485
3. Bad Experience with Attorneys
4. Anything else please explain
If 2, whats the guarantee that he will not cancel your LC/140 once he knows that you are filing on your own?
Sorry about bringing this up. My employer is ready to file 485 but not EAD and AP. He says if we don't renew our EADs on time then we will be out of status and hez seen lot of such cases. Can I file EAD and AP on my own and let my employer file 485?

Besides, I somehow feel that errors on forms are more likely when paralegals do your paperwork rather than you doing your paperwork.
I am planning to keep a backup of all paperwork to file on my own if the lawfirm fails to file it by the 7th or 8th July. I will fire them and tell them to back off and do this on my own. I think that if they cant burn the midnight oil and work overtime during such critical times, then they deserve to lose business and we deserve to take care of our problems.

I am surprised that all other threads are getting updated quite frequently. People are posting question related to their RFE and as usual once they get answer to their problems, they vanish. People are posting jokes on IV, but when it is their turn to call, we've to "bump" this thread and send e-mails to members. So pathetic.
I felt very sad when I read 30000+ members donated some 4000 dollars in last two months. I felt my donation of about 1000 dollars since 2006 is being wasted to answer questions of or to solve the problems of these free riders &/or one question members.
