next, I am in a similar 'somewhat out of status' position myself. i am filing for i-140/i485
I have been with the same employer since Jan 2004, and have every pay stub since then. However during some time in 2006, the company was in deep trouble, management takeover etc. and we were only paid for time spent on a major project (which was the cash cow). Because i was not directly involved in it, I was paid at about 50%, but every week, which lead my final W2 for 2006 to be around 76% of the total on the LCA. I looked at my paystubs and the total weeks at less than 100% is 5 months.
For 2004, 2005 and 2007 (on course) I am on course for my full salary. Also I got a bonus and stock options as the project took off and we are all in a better shape and my 2007 W2 should be higher.
Before 2004, I was a student on a F1 (MS degree) with one h1 in the bad days of 2002. However, my change of status was on the dot.. i.e. i got laid off on a friday and i filed my change of status to f1 the same day. My h1 visa was stamped in 2004 in India. My H1 was extended in early 2007
I am filing a self-sponsored I140. So, my question is:
1) Should I wait for 2008/whenever to file my i485 and hopefully show one year w2 and try to see if that goes through?
2) Try to convince my employer to pay me the back wages for 2006 (they may agree) in lieu of some future pay cut or paid out vacation or trade my stock options. File an amended return with a new 2006 W2 (what are the risks of an audit??)
3) Try to wait till 2008, stamp my visa extension and then file for i-485 showing only 2007 w2.

Please see one of the replies I have above in response to another post. You employer could not pay you, but it is not your fault. If a RFE comes up, you can file affidavits to that effect. You have to consult a good lawyer.
If you are not going to be leaving the US, you shouldn't have to worry about the H1 stamp because you should be getting a new I-94 with your H1 extension approval notice.

I think comparing both these data I can approximately say 90,000-100,1000 EB2 labors have been cleared in 2004 and 2005. That is like 2 lakhs applicants including primary and derivative applicants. Even if we put a 50% error margin thinking that there were more Eb3 labors, 140's are denied or downgraded to EB3 or a problem at 485 stage there are 1lakh - 485 applicants including Eb2 and EB3 waiting for 2004 and 2005. With a per country quota of 3800 + a bit of row how many years will it take to come to 2006 - where a lot of Eb2's are stuck?
I think it will take 10 years for a EB2 2006 applicant to get his physical green card including 485 waiting time etc.

Let us say that i agree to what ever you say. In what way does everything you stated above make a STEM graduate eligible for GC without an Employer sponsership. Why does it have to be only STEM graduates which will not need employer sponsership. If giving GC based on completion of MS in us is bypassing the employee sponserhsip then that has to be extended to all EB categories of immigrants (EB1/EB2/EB3) and the benefit o those visas have to be passed to the badly retrogressed category first.
It si not teh question of liek or unliking or having jealousy. It is the question of law. That is incorrect for my local ASC. I know that for sure. When I went to ASC for FP I do not think they were capable of answering any case related questions. All they do there is take FP notice , stamp it and do FP. They ask you to goto local office for any questions related to your case.
Secondly how come the IO had the authority to show an internal memo to a customer. Does it make sense?
Many are saying there won't be any IO at ASC. Not true, when I went in for Finger prints, I asked the lady who takes the finger prints about enquiring about my I-485 status! She said, she can't help, as she does not have the access and told me to call the 1-800 number and also try asking the IO at the window as there are not many people waiting and is the IO is free she might help.
SO, after finger prints, I went back into the office and there was only one guy talking to the IO another lady was waiting. I asked the lady, if she was waiting for the IO, she said she is here with her husband. She's an African American lady and her husbandwas inside the Fingerprinting room, I am guessing this as that guy sounded like from Africa and may he's a Family Based visa applicant.
Aftert the guy at the counter finished his work, I went to the counter as no one else was waiting there. I asked IO, a nice lady, if she could help me with the Status of our Name Check. SHe asked me, if I had an appointment, I said no, but I had a finger print appointment and I could not get an Infopass appointment around the same time (I had finger print appointment at 3 PM and I did try to get an Inforpass appointment around that time so that I could enquire about the status too, but there was none around that time and the closest one was around 12:45 PM, so I thought I would just try my luck).
She then said, we just received this memo and let me read it and said this supersedes everything and even everything is clear for you nothing will happen, asking me if I was from India/China hesitantly as she could fingure out I was from India, untill new visas are allocated in October. She then took our I-485 receipts and went inside to check the status of our applications.
I am in Midwest and not all the USCIS/ASC offices treat as bad, as these guys may not have that many applicants coming to the office, like int Northeast or California.
I had talked to her earlier also, after taking an Infopass appointment, as I had receive someone else's EAD and went to return so that the actual person would get her EAD. Last year USICS had sent some one else's EAD to me, the EAD was some one else's, but the letter it comes with was in my name (I had also received my EAD separately, strange are the ways USCIS works and I don't have to tell the guys at IV). Then also, she check status of our applications and told out namechecks were not cleared and finger prints were cleared. SHe even told, even if my wife's checks are cleared they would not apporve her untill my applications is approved. SO, I had this hope that this lady might help this time without Infopass appointment.

I attended the "conference in Boston" earlier this month to which three core members had flown in and had the first hand opportunity to discuss with them. The dedication and resolve they showed approaching key people in lawmakers office was just so inspirational. Specifically, the way Aman was talking to individual IV members without taking anything for granted. None of it was for individual cause but for the entire team which means "you". So the best we could do is help the group financially and provide the means to approach for more stronger lobbying efforts. Let's be real, at the end of the day, money talks in the senate ! and we all can contribute little by little and provide the backbone for us and incoming generations..so let's do it folks, please step up...all required is $20 per member...

I am hoping realizeit is in the process of contacting IV core and will update us soon. If not, realizeit please update as to what you are planning on doing.
After IV core gives us the go ahead, I think we should take your offer on the bridge call.
I would also suggest, not sending any mails yet to Ombudsman till we form a plan of action.
Ofcourse, still eagerly waiting for desi3933 to get back to us with cold hard analysis to set us straight :)

What is even more frustrating is that we are chasing this so called American Dream during the most potent years of our lives and literally wasting our lives away.
That's exactly it Ragz. That one statement summarized it all. The MOST potent and important years of our lives and our spouses lives are going Right down the drain. I feel even worse for the spouses. Atleast we HAVE jobs and our careers are going SOMEWHERE. The countless spouses on here and even more so not on here are suffering away today for a better tomorrow. It may just happen that when the Work permits/ GCs do come thru, our spouses' skills may be extinct due to having no work for so many months/years.
This is definitely an angle to explore. As my spouse was telling me the other day. God Forbid, if this problem lasts for another year and then some of us decide to move back coz we are tired of this nonsense, our spouses will find it just as hard to find jobs in our home countries as well. Think about it, our home countries are pumping out fresh blood everyday. Will the companies select them, or someone who has been out of touch with the job scene for 1-2 (or many more) years?
