I completed my MS in Computer Science from US around 6 years back, was on OPT for a year & thereafter moved out of US & came back to my home town. Have been working here for 6 years now in the software field & have now applied for H1B under masters Quota. Was wondering if I am eligible to apply under this quota as I am neither a fresh masters graduate nor have any status in the US. Also, my lawyer has only filled out the I-129 form. Is there any special form that needs to be filled out to be considered for Master's quota?

I am going to file my h1 application tomorrow under the master's qouta. I know its nearly impossible that my petition would be approved but I have no other choice. I just have one question:
1. Should I go for a premium processing?
<<My OPT expires may 15th and my employer is still willing to file my h1 tomorrow. If I go for premium processing, that will atleast stop me from getting an admit into a community college this fall to maintain my status>>
Advice please. Also there is no way they will increase the h1b on the master's qouta, right ?
I think you need to wait until USCIS finish they Lottery/Sorting process.
At this moment they won't accept your application.
Please contact your Lawyer for accurate information

Signs of a maturing organization and community....
It's always best to put oneself in the other person's shoes and see their point of view, if they have one.
Having said that, I would urge IV members to not respond to such comments with inappropriate language or responses. Remember, this is an organization of "high-skilled professionals", and act like one.
cheers, and see ya'll in DC!

he is just expressing concern that more action is not taken. i wrote param a pm to explain, also this thread will not continue indefinitely. we do however need to be clear in our stand and in our actions. we should be able to enunciate what we believe without resorting to the kind of vitriol that is thrown at us. personally i am waiting to see that- it's important even to grow as a community and achieve success that we develop this ability. our strength lies in the facts not in any hate or rhetoric.
be rest assured that ip's of those that post such stuff are tracked for action.

I disagree that substituted labors has really impacted immigration..Those labor certifications that were once filed were thought to be used for some one anyway. If the original applicant wasn't laid off or hadn't changed plans, he would still be ahead of the current pending applicants. It's not the biggest of our current problems.

Yup. Make a group, pool the contributions. One member collects the money after making $100 pay pal, google contribution. This concept can be extended to $200 , $500 too, if you can form big enough groups.

This is a good start but more work is needed. You need to highlight how arbitrarily NSC stopped approving after Aug 20. TSC still kept approving after that and even NSC issued an approval 2 days back. Clearly, the statements about visa un-availability and avaialbility have been inconsistent.
Also, I think sending letter to Ombudsman is useless.
We need to send to Zoe lofgren.
Also, we need to highlight that only 15 days are left and action is needed within that time to issue more approvals.
Please also highlight how NSC went on an ridiculous RFE issuing spree after complaint faxes were sent.
We need to definitely start sending letters on monday. Otherwise, it will be too late.
Folks,
I edited the letter so please take a look at this version. Some of you'll have suggested I condense the letter to a series of questions alone - I think this is a good idea and will be more effective in capturing attention. I will prepare something in this format (but it will have to wait for the weekend).
For now, my intent with this letter is to ask that the ARBITRARY nature of the visa bulletin be put to an end. I am exhausted by the cycle of raised and dashed hopes when the visa bulletin moves forward and backward.
To those of you'll who brought up the issue of schisms between EB2 and EB3, please read paragraph two above. Let us correct this randomness before we tackle each of the issues that are making life so difficult for us. You could start by gathering your friends, co-workers and other EB3 applicants and put together your list of issues to be addressed along with solutions. My view is that if USCIS is incapable of taking care of the matter then we have to pitch in and suggest/prod/request/demand it of/from them.
Together we can do it!
And here's the letter:

Sir/Madam,
On behalf of the employment-based legal immigrant community in the United States of America, I am writing to highlight the ongoing egregious inefficiencies in the immigration services provided by the USCIS and the DOS. There have been numerous occasions when there have been erratic movements in the DOS published visa bulletin dates. This, as we understand it, is owing to USCIS under- or over-estimating the number of applicants available for adjustment of status. And in the rare instances when the date finally moves forward by a substantial window, USCIS tends to approve the more recent applications as opposed to the ones that were filed earlier. Let me explain with an example: in the July 2008 visa bulletin, the cut-off date for the India EB2 category was 01 April 2004. A month later, the cut-off date for Indian EB2 applicants abruptly moved forward two years and was set at 01 June 2006. Instead of approving applicants who applied in 2004 and 2005, USCIS approved applicants from 2006. Where is the justice in that??? Why bother publishing the cut-off date if approvals are to be randomly allocated???
We understand we have to stand in line and wait our turn. Each applicant is assigned a priority date which chronologically determines his/her turn for approval. To further complicate matters, once the I-485 is filed, a crop of other dates are issued by the USCIS a receipt date, a notice date and a processing date. USCIS then takes the liberty to throw random rules at us Case adjudication is based on receipt date No, we process applications based on notice date, Actually, its the processing date that determines which applications are adjusted. !!!
Please take a moment to consider how these conflicting statements and arbitrary decisions wreak havoc on our morale and psyches? No one, NOT even the USCIS, has a clue as to what exactly is happening in their processing centers. The USCIS has never been able to clearly state the exact number of applications languishing, excuse us, we meant pending, in their service centers! We, employment-based immigrants, are tax-paying, law-abiding, educated individuals contributing to Americas knowledge economy - yet we have been subjected to the worst aspects of the US employment-based immigration system. These include:
1) Extended wait times at each step of the immigration process.
2) Lack of transparency on the part of USCIS (re: priority date, receipt date, notice date).
3) Lack of USCIS customer service once applications are submitted to USCIS they disappear into a black hole. Barring a website where one nominally can check ones case status (but which in reality remains static for months, even years!) there is no concept of updating an applicant on where his case stands. And this is despite the applicant paying immigration fees that often run into thousands of dollars over the years. We are simply expected to wait in a complete void of information, for however long it may take, until approval.
4) Lost opportunities owing to the lack of job portability during the process (a time period spanning an average of five years, whereas an applicant from any country besides India gets his/her PR card in under two years).
While we are grateful for the opportunity to partake in the American dream, it is ironic that we arrive in America and find that our freedom is shackled we are bound to our sponsoring employer from the start to the end of the extremely lengthy process. Although legal immigration reform is our ongoing aim, for now, we sincerely request you to investigate the process whereby the monthly visa bulletin is set and to ensure FIFO (first in, first out) adjustment so that those of us who have been waiting longer receive attention prior to those who have applied later. We want USCIS to be accountable to us, its paying customers.
We request you to lend us your ear and address these issues so that we are not subjected to them in the future.
Thanking you,

Please do not forget the guywho sets the visa dates.. think he is called charles Oppenheimer or something.
He is the one who needs to look at the past visa dates and go "USCIS.. I need stats to predict this more uniformly and fairly"
And we need to raise stink about this since he is not doing his job properly .. or maybe he just doens't realize the ramifications of his actions
Just created one more poster.
http://docs.google.com/Doc?id=dd4vkcmm_132g6jcsffz&invite=hczhh8x
One of the persons should be Director USCIS.
One letter/poster to each service center.
One I think should be President of US.
Another place could be CNN, FOX news etc.
Another one could be Congressmen
If we have our blogs , we can post them there also.

donated $50; learned about the organization on June 8, participated in the event - not knowing any of the issues. Was an eye opener to the legislative process. I did not do much, just accompanied the IV members to the meetings - these members were well prepared to present the case as well as to answer questions. I am impressed, and here I am registered and donated.
Thank you IV for being pro-active. Feels good to be part of the action.

Potatoes, maybe.
But seriously growing your own vegetables is a fun activity. I have not done groceries in the last few months (exceptions being junk fast food, yoghurt etc). We grow vegetables all year round. In fact we have excess of most vegetables we grow. Try it, its a lot of fun!
And good luck to all EB2 and EB3 folks - we've seen good EB2 movement and we hope we'll see more movements in both EB2 and EB3 in the days to come. Till then, Happy gardening!!
PotatoEater,
I grow different kind in my backyard. It all depends on the size of your backyard and which zone you live in states. I live in virginia. By this August end /september first week summer crop will end. I grow tomatoes(30 plants), Mint, snake guard, water melons (15 plants), cantaloupes(10 plants), carrots, okra, spinach , chillis. Its fun and hard work too. You need to dig the soil, mix with top soil or garden soil and cultivate it. Every week fertilize it. This is my first year gardening. I have around 3000 square ft of back yard. i do not know what to do with that. I cannot maintain Lawn in back yard. So I decided to grow vegetables.
I am eagerly waiting for my fall garden..I am planning to grow tulips, beets, cilantro, carrots, potato, peas etc., If I can get same space for garden In India and work place just 3 miles from home , I can happily go back to India.

I think the IO just say anything that comes into their mind because they know nobody's there to hold them accountable during the interview process. Thats why I think one should take an attorney along during the interview process if they think their case maybe little complicated. At least the attorney can step in when it comes to the IOs denying your application improperly. Does anyone think this is a good idea to be on safer side?
yes..totally agree...it might cost around 1000$ but I think ppl shud take attorney..I felt the same after the interview.
I had every damn document for the last 6 years..every paycheck..all 94's..all empl..letters..
I felt it was a clean case..but you never know.
If possible, take attorneys with you

Someone gave me RED dot for my posting/interpretion of memo (as below). I don't care but some level of maturity is expected on public forums:
If at all this 'news' is true -this may be just something so-called internal matter. Best interpretion of this 'news' is: They may have assigned available visa#s to approvable petitions just as they did before 2nd July07 bulletin, where people kept getting approvals well into Oct07.
So, ALL THE BEST to lucky ones who are 'pre-adjudicated'. How else you can explain Sep VB, which is yet to start from 9/1.
Just sent you pm.
