I saw there are 50 replied to this post. Looks like people are more interested in others problems than their own.
Its pity that MOST CRITICAL issue we are facing at present - AC21 Denial issue, is having only 77 mails but everyone is jumping gossipping. Come out of this and show a unity to real problems.
Grow up and don't escape from real problems. Its our problem and we need to fight to resolve it.

Instead of allowing US STEM graduates to get GC based on US job offer it would be beneficial to instead allow US STEM graduates to apply and get H1B without any quota. Tht way they will get into the system and don't need to go back to home country. Giving GC to STEM graduates directly is wrong by law because it bypasses labour and 140 conditions which state that a company is willing to sponser GC for a person based on current market conditions.
Its already there. 20000 for masters and phd students.
Giving GC to stem is to bypass them from EB based line, which means they won't consume numbers from 140k. Isn't this good?

Senthil has articulated legal basis of current system. However, many members feel agrieved by current situation. My displeasure with current law was based on my perception about principles of natural justice and a dogma that one measure (current provisions) should not negatively impact other's basic rights for happiness, equality, nondiscrimination etc. Courts could take a look at how much damage or injury is possible or actually already resulting (stalled careers, family separation, life on hold, creativity-innovation halted) in current system. Atleast it will open up healthy debate and rational measures to address genuine problems.
Could anybody clarify as to whether counting of family members towards annual quota is mandated by congress or it is an administrative provision.

To approve her application for a green card, USCIS would need to agree that she was an artist of "extraordinary ability," defined in Title 8, Code of Federal Regulations, Part 204.5(h)(2) as "a level of expertise indicating that the individual is one of that small percentage who have risen to the very top of the field of endeavor."
To the upper echelons of literary publishing, Li looks like a slam-dunk to meet this definition. Not to the USCIS, however. A year after she filed it, her petition was rejected.
She has appealed. A USCIS spokesman says she is likely to get her answer in a few weeks.

Here is another case:
My minor daughter's Last name was missing in her passport but all her immigration documents (I-94/H4/AOS- r. n/ EAD/SSN, yes she got ead for ssn but never used it till date) somehow had her first name + LAST NAME. We initially ignored her missing last name in the passport but during her AOS finger priniting, asc guy noticed missing last name, made a noting in their system as "LNU" and advised us to get it fixed. We went to Indian consulate, Chicago and got the last name entered in passport, after due paper formalities.
My question to you guys is: Do we need to do anything else with respect to her AOS as all her uscis documents including I-94/H4/EAD/ssn, are already wth first name + last name ?
Any suggestions on this sitution will be appreciated !
If First/Last name in all immigration related applications/docs match with entries in corrected passport, I don't think you need anything else. Green Card, when received, should have entries as in passport.

By god grace , we will make sure that Strive act does not pass. Especially, the portion that talks about employment based category.
What an intellectually bankrupt person you are. If in 25 yrs time, someone who would bring skills that improve America's economic competitiveness and strengthens this country's overall quality of life is being brought here by a Lear jet, why would I crib over that, saying I only came in first class? I would roll out the red carpet, it would not be about me, it is about what that person is bringing and the need for it here that determines this. What don't you get in that?

2. What exactly did the memo say? Now be careful and think hard before you post.
For instance, you may cover the following in your post:
- Who was it addressed to?
- What was the subject?
- Was it about about EB or FB?
- Did it mention any dates?
- Did it mention any country names?
- Was there anything about what the adjudicators are supposed to do?
- Which city/state was this?
