    Well, I am no lawyer, but IMHO, it should not be an issue. Several people have posted comments regarding the A# and have found that some have it, some don't.

    There is a post somewhere that explains different types of A#. I am still a bit fuzzy on this.

    Mamit: Take a deeeeeeeeep breath! Good for you that you are dealing with this right at the start of your career. Get all the bad stuff out upfront. I have a family and life to take care of in the US and I am stuck in this crap since Jan 7th. It is extremely hard and frustrating - but there is simply nothing that you can do about it right now. So, relax and wait it out.

    The PIMS stuff is all messed up and iff you have a common name, your lottery for "Security Clearance" may have come. That would significantly add time to it. If this is your first stamping - the chances of rigorous checking is higher - although that is not always the case.

    It is easier said than done - but seriously, let the life take its own course, this too shall pass and soon!

Actually this time I asked my friend in US to call DOS, and he used the computerized answering system with my petition number and they did say that my H1-B petition has been approved. I don't know if I mispronounced/mistyped anything when I did it last week, but at least now I'm sure that it is on DOS' system. Thats the same thing I heard when I called KCC, that my petition was approved in April 2007. Or maybe I should've asked them if they've access to PIMS. It's frustrating man, I never thought at this stage of career, entry-level that is, I will be stalled by things like this. Well I hope in the end I can find a rational explanation to why things turned out the way they did.

    For the new folks in the forum, its been 75 days and am still waiting for my H1 visa. I guess I should also talk to that Mexican Emabassy and see if my case shows up on the PIMS or not. The only problem with New Delhi embassy is that when I call them, all they say is that the case is still pending, and nothing else. I don't even know if I should curse them for being incompetent, or maybe that is all their job entails (I'm not being condescending here). Is it advisable for me to go to New Delhi personally? This is a mess, but as long as its in God's design, I'm ok with it. I just don't wanna feel later that if I had done this ... blah blah, then I could've expedited the whole stuff. That'd be a bummer. Well at least I need to be focussed and keep my head straight. That I can control, and thats what I'm taking solace in.

    I am surprised to see this thread active this long. Earlier I have with help of Saralayar and other members have bring this point to attention. But at that time no one was supporting Idea.

    I see increasing support for the Idea as GC journey become longer and longer.

    Earlier I have pointed following points that I want to bring to remind if we want to get real support for this idea of early CITIZENSHIP AFTER GREEN CARD

    (1) I-140 and I-485 must be approved.

    (@) Time should be considered only after getting GC

    (3) For getting closer for political support our proposal should be close to Existing laws for FAMILY BASED and MARRIAGE BASED CITIZENSHIPS

    So we should argur that if YOU HAVE MASTER AND ABOVE IN STEM FILEDS YOu can get CITIZEN SHIP 5 yrs from date of Approval of I-140 ( which make it closer to fmaily based) and THREE YEARS from Date of Approval of I-485 (closer to marriage based citizens). You can get earlier of two . But when you get Citizenship your I-485 must be approved for ATLEAST 1 year.

    The above requirements can get closer to Marriage and family based and also help 90% of IV members.

    Adding the clause for the EDUCATIONAL THING might be able to get more political support also

    Looks like they forgot to ask to attach the following :):):):)

    1) Copies of all your certificates
    2) Your latest offer letter
    3) Pay stubs for last six months
    4) Tax returns
    5) Letter of introduction from the employer
    6) Latest Resume
    7) 3 Recommendation letters
    8) Family photo with Mother, Father, spouse, kids , siblings. While background, taken less than 6 months ago. Frontal view :)

    Avoid them at all costs....

    Good one. But don't give those fools any more ideas. They have already started a new project to incorporate the above "points" in their next version.

    Why is everybody so happy? He has just briefly and curtly informed in the message that flowers will be forwarded. They won't be sitting on my desk and embarrasing me. There is no acknowledgement of the issue or any empathy or compassion with the sufferers. Now even the press coverage will make USCIS director look good. I don't see what's the positive development here.

    I guess we'll need to ADD to that number:
    1. BEC stuck folks who could not file in July 07
    2. PERM approvals starting August 07

    to the 47,728. Plus multiply by 2.1( for dependents ). That'll give the total VISA numbers required for this category to make it Current.

    If I have to guess-- (1) would be very less, may be 100-200 max
    (2) around 5000 ( just a PUMA)
    So, there are about 53000 EB2 I applications. and 2.1 * 53000 = 111300.

    If we can create 111300, EB2 I visas then it'll be CURRENT. easy:)

    I do not think you need to multiply 2.1 tp 47728. So it could be max 53,000

    Did anyone see any Soft LUDs on their 485 or old EADs before their approvals/RFEs?

    My PD is June 7 2006, not current. Yesterday, I had a soft LUD on my 485 and my first EAD. These two haven't seen any activity since early 2009, and I'm wondering if this means anything or if I'm reading into this a little too much.

    It's too late flowers have shipped. They will have to be delivered somewhere, it'll just force the fedex/dhl not to accept a forward from USCIS.

    Yes, the same law can be interpreted like this:

    EB1-ROW unused visa will go to EB2-ROW
    EB2-ROW unused visa will go to EB3-ROW

    Same for each country.
    But its not happening. What actually is happening that they are giving unused visa from EB1-ROW to EB2-ROW to EB2-I/C. WHY?

    So EB3-ROW is retrogressed bcoz it doesn't get any spillover and hence it affect EB3-I.

    So where is the correct interpretation? Does any body know?

    Don't take me wrong here. I don't favor EB3-ROW or any particular category. I am EB3-I with PD Nov 2002.

    Suppose Eb1ROW--> EB2 ROW --> EB3 ROW like you say , and EB3 ROW becomes current. Now what?

    Wouldn't the unused EB3 ROW go to EB1 -C/I --> EB2 -C/I--> EB3 -C/I instead of directly EB3 ROW --> EB3 -C/I?

    I think EB2 C/I is the bottleneck.

    No matter what you do, pushing for the recapture bill and removing country ceiling is going to help EB immigrants overall.

    Yes agree. The point is that for an example in September 2008 if you used AC21 then on that date you and your employer claimed that your skills are matching for "particular EB3 job classification" . Now if you go interfiling to USCIS in March 2009 then USCIS doubt as logically employer ca not establish the "natural skill progression" within 6 months.

    One more thing - RFEs. Although people used AC21 in 2007 or start of 2008, just recently USCIS sent RFEs to many. All of them have just finished replying those RFEs in which hthey claimed that they are still working on a "same job" matching EB3 skill. My employer sent that RFE response in May 2009. So my clock starts again from May 2009. In December 2009 it is almost impossible for my employer to show that " I am fit for advanced skills". So this is the glitch that lot many lawyers are strongly hesitant to proceed on interfiling.



    But I have already taken the promoton on Jan 2009 (raise and change in job requirements since I filed perm) and moved to the new eb2 position...I dd that after a year and half from eb3 485..... the job is same/similar but requirements and skills have changed

    but as you mentioned
    I should stll be ok and just make sure I interfile 485 after 3 years ?

    Seems like there might be an internal memo or understanding between USCIS and DOS not to approve many Eb2 India 485 even though there dates are current, this is the only explanation I can come up for the lack for eb2 india approvals in October. Even with the limited number of visas every quarter I was hoping there would be lot of approvals because of Visa spillover occuring every quarter instead of once every year, but looking at the USCIS performance in the first week of october it seems like there wont be any quarterly spillover at all.

    Mine seems to be few of last applications entered in system during July 07 visa bulletin fiasco(rather fiesta). My Notice date 10/17. I have not seen July filer notice date, later than this...

    My notice date is 10/10. It seems cases are approved based on the notice date. My case was transferred from CSC to TSC. You are right that only few cases have Oct notice dates.
