also got the following response for a service request i put in. did not know what to make out of it - is it just a regular response or is this true

Great discussions!! we are all going in different directions... How many Labor petitions few handful? There might be ppl who are stuck legitimately and ppl who did it , it was legal. Rather we should concentrate on Retrogression of VISA numbers. Then what after July 07 , think also about 140's there were pending there are a handful with earlier priority dates. Also many times USCIS issued GC's for ppl with earlier PD's should they return their GC back ? And potato eater has mentioned its not point to argument. I dont think there are those who are blocking the system. It is sheer number of VISA's that are driving nuts. There were also proposals that VISA numbers be applied only to principal applicants. Actions like these will have impact on final numbers.
And above all this idea is not new , It was even discussed by many members (in ~2006) when Substitution was abolished. But we are already here. We will campaign like Rajiv Khanna had said and then what discuss new proposal ? I feel its not that easy to do a change for existing ones in pipeline and USCIS has completely abolished this idea altogether.
Main action agenda: Legislation to get back unused numbers. I dont want IV to waste energy or resources anything beyond this and we shouldnt keep on discussions of new proposals. Our only point of discussion should be How to get legislative fix done.
Come to think of it, this idea has potential to fly. We can ask CIS to make the date of I-140 filing as the PD for substituted labor case. This will ensure that PD will move forward smoothly till July 07 at least. That will cover most of the long standing ( and long suffering) GC applicants and bring them relief. This will not have any other impact on the number of outstanding apps or available visa numbers etc. I guess this change in PD assignment logic can be done by CIS without the need of any new legislation.
The idea inherently appeals to those who believe in fair play. How do we take this forward.

To all IV non participating members (DC event),
The phenomenal experience of actually doing something positive to solve our problems is priceless. Every member that came to DC from all across America were dedicated and focused - many volunteered to help the IV Core (and in spite of doing many things ahead of time, there was much more things that needed attention!!).
On Monday and Tuesday, while I manned the phones, it was heartwarming to get calls from members who were in the Hill, calling and asking for more meetings - If they finished their meetings and had time before the next meeting, they called in to say - "is there a group we can join - so that we can be in a larger group?" or while they walked in the hallways, they would spot their congressman/congresswoman's office - and call in to ask if they could go in and just introduce themselves and ask for an audience. Mind you, this is not an easy task nor did they get to talk to staffers - but I am just acknowledging the great enthusiasm that was vibrating with our members - they realized the gravity of the situation, the opportunity that was within their grasp and wanted to make the best use of it. Hats off to you guys!!
IV realizes that our strength lies within our members and their dedication - both in terms of participation and funding. And if there is one thing that almost every single participant took home from the event is that - we still have a long way to go and we need far more support and participation.

According to DHS statistics there are around 50,000 EB2 lndia Labors in 2004 and 2005 each. So ppl with 2005, 2006 priority dates you can wait around 6-7 years for ur priority dates to be current with annual limit of around 5000 for EB2 India.
The lawsuit can be filed by your American Civil Liberties Union Member or ur aunt or uncle or mistress who is a US citizen. U guys and gals with 485's will not be there in the lawsuit but will benefit if the lawsuit wins.
I looked at the links you have provided and I'm still not sure where your "50,000 EB2 India Labors...." came from. These numbers do not seem trustworthy or reliable.
Here's data directly from the DOL ETA website.....
3/28/2005 to 10/28/2005 there were a total of 15973 Labor certifications approved - that includes EB1, 2, 3, 4 for all countries, and 3734 cases for Indian nationals in EB1, 2, 3, 4. Of course a part of EB1 and all of EB5 don't need labor certs.
If you download the database from the DOL website, apply filters for India, approved cases, then filter out all Level I in all non-managerial occupations, followed by non EB2 job descriptions - you end up with ~ 8 - 9% approvals for EB2-IN which is approx 1300 - 1400 primary applicants.
In my estimates, i removed most computer programmer level occupations as the USCIS has been very reluctant to approve EB2 for these cases - i could be wrong here.
As you see, it is IMPOSSIBLE for EB2 IN cases between 3/28/2005 to 10/28/2005 to be much more than 3800 (that is approx 3800 x 2 visas incl dep).
A total of nearly 50000 EB2 IN applicants (including dep) for 2004 and 2005 may be possible.
The massive retrogressions we are seeing is mainly because of the fact that only 15439 EB2 visas were issued in 2003, and 32532 i 2004 thanks to DOL backlogs and mis-interpretations of the law by DOS !!!! compare that with an average of 43,000 in most other years since the 1990s.

I think option 1 is best. We can request members to put the FOIA comment while paying. This is for IV leadership to track FOIA specific payments.
Option 2: Who ever is actually setting up the paypal account needs to be aware of tax issues. We don't want to pay 30% of our $5000 to UncleSam.

If the authorities were really clever they should have accepted the 65000 with highest salaries instead of doing something random like a lottery. This in turn would have forced employers to raise wages to have a meaningful shot at getting a visa.

I'd like to thank each and every member of the IV Core Team. Your efforts have changed our lives. Because of you, people won't be scooting off to UK and Canada, some children won't age out, people wouldn't have to get more *ouch!* shots, et al! From skepticism to total admiration is how my perception of IV changed over the past two weeks. You have done justice to the name Immigration Voice. Enough said!
Like the Core Team repeatedly insists, this is just one of the first few important steps, and there is a lot more to be done. And for that to happen, IV needs contributions. I am not in a position to urge people to contribute. I am a junior member, 20 years old, on an H-4 with no means to work, and not a single bank account yet to my name. However, I wish to pledge the first 500 hundred dollars of savings from my first job after obtaining an EAD to Immigration Voice.

On a positive note, the best that we can do is, learn from our surroundings. We can learn a lot from Republicans to understand what not to do.

Hello guys,
Sorry for this non-immigration related post. We have this sudden, tragic situation that I wanted all of your advice on. Thank you for your time in reading this long post.
We had hired an Indian nanny in NJ who, we learnt after hiring her, is here on a tourist visa. We were paying her $350 per week cash, which is the standard rate around here for nannies (incl. citizens and people on GC). We had liked her when we met her in response to an ad on Sulekha, and we thought an Indian nanny would be good for our first child. She has been with us for about 3 months, and we were intermittently not getting a good feeling with her for some reason. We finally bought a small security camera and installed it yesterday. On the very first day with the camera, we came home and saw the recorded video to find that she is violently hitting the baby on two separate occasions. Needless to say, it has shocked, angered and extremely saddened us. I showed the video to a couple of friends and even they say it is unbearable to watch. This was just the first day of recording and it pains us tremendously to think what all may have happened previously.
She is of course not going to stay with the baby alone anymore, but I want to know what legal options I have to penalize her to the fullest extent, so that she does not do this to anybody else�s small babies. She it seems had come here last year and taken care of someone else�s baby in Hoboken, and I can imagine that their baby also went through this. (This woman and her husband are a ~ 35 year old couple, who have a multiple entry ten year tourist visa; both come here for 6 months every year and work odd jobs like this. They apparently got a (unsponsored) tourist visa after showing a lot of landed property in India).
I specifically want to know if I will have potential problems if I go to law enforcement about this- regarding have employed her (both of us are on H1B visas). I know we have made mistakes and should have done better due diligence in this, and there cannot be any more punishment for us than seeing our 8 month old � who cannot tell us about it when we come home- being beaten on the tapes. We saw this yesterday and have not told her yet. We want to weigh all options before we proceed, but from today onwards one of us is home all the time till Friday. Any advice or opinion is sincerely appreciated. Thanks for reading this long post. And, to all who are thinking of nannies or have one, please learn from our mistakes and closely monitor your child�s safety every day.
As a parent of a 6 month old I can imagine what you are feeling. At the sametime given the circumstances I would not recommend you considering any legal action. Given the fact that you are aware that she is illegally working and that you were paying her cash weekly etc will only create trouble for you. I realize its hard for you to let this go considering its your own little baby but in the long run it will help you and your family. Kick the lady out of the house and tell her if you ever see her around your neighborhood you will have her arrested for assault.
