Following up on my previous post. Here is the format for the ad and the affidavit. We went to the DC embassy to get the name changed and they have next day (business days only) passport-by-mail service. I don't think they have same day service.
Actual correct name: <corr_first_name> <corr_last_name>
Current Name on passport: <first_name_pp>
Name in US docs (Visa, SSN, Drivers Lic.):
<first_name_us> FNU _OR_ <first_name_us> <first_name_us>
Format of the ad we placed in Indian newspaper (TOI) and local US newspaper:
I, <first_name_pp> AKA <first_name_us> FNU AKA <first_name_us> <first_name_us> d/o <dads_name> R/o <indian_address/us_address> have changed my name to <corr_first_name> <corr_last_name>.
Format of Affidavit from India (on Rs. 10 Non Judicial Stamp Paper):

I, <first_name_pp>, D/o <dads_name>, R/o <indian_address>, do hereby take oath and solemnly declare as under:-
1. That I have declared my name as <first_name_us> <first_name_us> earlier.
2. That I have declared my name as <first_name_us> FNU earlier.

4. That in future I may be called as <corr_first_name> <corr_last_name> for all purposes

The deponent above is the person whose name is being changed. Since my wife was here and the affidavit was to be made in India, my mother-in-law signed on my wifes behalf ...you know what I am saying... (ah! the things you can get done in India)
We found out at the embassy that we could have used our India issued marriage certificate (which had my wifes correct name) and avoid doing all this. Placing the ad, getting the affidavit and posting it to US all took a total of 1 week. We went to the DC embassy early on a Friday and we got the passport with the name changed via mail by Monday.
Another friend of mine got the same thing done via the mail-in service. It took him 2 weeks to get the passport back.

After hearing this, do you think our folks will sit quiet. We will do whatever it takes to makes sure that American jobs stays American.

Last time around, there are lot of cases in preadjucated state, So, they were able to approve in thousands. This time, most cases they did not touch till now. That makes it difficult to expect lot of approvals.

We might have a reporter who wants to write an article but is looking for an EB2 from the state of Texas. Currently we do not have anyone that fits the criteria. We would lose this chance which anyways are not easy to come by.

I am also trying to go through the process of getting my spouse's name changed. I got good information from all your posts, but I am trying to understand the order of steps to be followed:
So,
1. Place ads in newspapers in US and India
2. Get the local court order
3. Mail all the required docs to respective Indian Embassy in US along with court order
4. Once passport received with new name, use the court order and passport to change names in SSN, drivers license etc.
5. Once all of them are changed, send all copies to USCIS (New name will be applied with next stamping and for now we ll still carry old and new passports pinned togther)
Please let me know if I am missing something and any details if possible.

2). Then i changed my Visa to H1-B in 2005.
3). I was asking my employer to file for change of status from L-1 to H-1.
4). Those guys filed for a new H-1 and sent it to a consulate in India.
5). I was not aware of this and i thought i am legal till september the expiration date on my Visa.
6). Labor got cleared in July-2007.
7). Thought i would file for I-140 and I-485 together and found out that my I-94 was expired since September-2006.
What is the best course of action here to remedy my situation??
Any advice or details of a great Immigration lawyer who dealth with such cases before would be of great help.

I beg to differ. IV is not turning away anyone. What stops someone from contributing $100 once every 10 months?
The issue is something else.
In order to contribute even $10, you need to:
1) be convinced about the cause of IV
2) be convinced this organization means business!
3) give up the "penny wise pound foolish" attitude
(1) This should be easy for those who were unable to file their AOS applications in July/August 2007, because one of IV's primary goals (abolish retrogression) should then be your goal.
This is also easy for those who filed their AOS, if only they realize that "working on AC21/EAD" is not as much fun as it seems, you really need the Green Card to live and work the way you want!
(2) is a proven fact, and most of us are already enjoying the benefits of this!
(3) Finally, people feel overwhelmed by the thought of donating $50 or $100 to IV but they are happy to spend much more on gasoline, phone-calls, and drinks. You make no difference to your quality of life when you spend $50 on gas and $100 on food when you go sight seeing on a weekend. But when you donate that money to IV, you are supporting the one and only grass roots organization that means business when it comes to fighting for your own quality of life!
It's like investing in a "credit score" monitoring product for a year before you actually apply for a loan!
If that analogy makes sense, please please realize you need a similar strategy for your green card, and contribute to IV.
Preferably, sign up for recurring contributions, as this is the one thing that will help IV in forecasting and planning.
If nothing else, write to a core team member and let them know you will pay $N1 over N2 number of months.

Once you've fixed/changed your passport. The correct name would be available for use on your AP and H4 upon subsequent renewals.
Once you've got your new passport - I would suggest contacting uscis for fixing 485.

I am assuming she doesn't know that you can't go to the authorities. So..(this might sound stupid) you can threaten her that you will report her unless she refunds all the money you paid her. This is the best possible punishment I can think of.

This idea has only one problem, it makes too much sense !
If the motivation behind the immigration system was to benefit the immigrants, things would not be where they are today. Think about it, all these RFE's, NOID's and MTR's are the pieces of paper that generate revenue for the USCIS, the lawyers involved and the whole bureaucratic set up. Now why would a common sense solution like yours be implemented which benefits only the immigrants and stops oodles of money from coming in? The whole idea of giving people EAD's and AP's (ie the defacto rights of a green card) and forcing them to renew these documents for years instead of simply giving the green card is preposterous. The excuse given is that it is the law and changing the law is hard. Changing the law is not hard, changing the political realities of a nation entrenched in xenophobia is what is hard.

Few big question we need answer tow
1) Why is there no forward movement of dates if there is visa was available from this year/quarter's quota... what is up with retrogression?
2) If visas were unavailable, why was the fucking date advanced to Sept 2006?
4) Why was FIFO not followed during adjudication?
3) How the Fuck long do they need to determine the backlog ..? we need USCIS to publish the backlog stats. Without that visa bulletins are pointless?
Enough bullshit.. as some user suggested here .. we should just raise stink and ask for their resignation
All the 485 cases filed are i their system, it s simple fucking sql query .. or a join at the best ... a blind monkey with hair on its breast could find an aswer to that question in a few mins.
