I just want to generate enough internet chatter so that the issue of substitute labor will come on CIS radar. I know for sure that a huge fraud was perpetrated during July 07 fiasco by some unscrupulous consulting companies who sold pre-approvevd labors like frozen pizzas. Just heat and eat.
And I also know for sure that IV has gained enough publicity that CIS folks might be tempted to check it now and then. May be they will take notice of this thread and start investigation of all the subst labors.

I would suggest two things:
1) Fire her and let her know the reason. If possible show her the video, that will definitely scare and embarrass her. You cannot undo what she did to your child but that will teach her a lesson and hopefully prevent her from doing that to another child.
2) I would highly recommend sending your child to a reputed daycare. Ofcourse your child will not get personal attention like home, but that ensures the safety of the child. There are other benefits of a daycare like - social interactions, personality development, fixed routines, curriculums, and above all they are trained professionals.
Give it a thought.

We had hired an Indian nanny in NJ who, we learnt after hiring her, is here on a tourist visa. We were paying her $350 per week cash, which is the standard rate around here for nannies (incl. citizens and people on GC). We had liked her when we met her in response to an ad on Sulekha, and we thought an Indian nanny would be good for our first child. She has been with us for about 3 months, and we were intermittently not getting a good feeling with her for some reason. We finally bought a small security camera and installed it yesterday. On the very first day with the camera, we came home and saw the recorded video to find that she is violently hitting the baby on two separate occasions. Needless to say, it has shocked, angered and extremely saddened us. I showed the video to a couple of friends and even they say it is unbearable to watch. This was just the first day of recording and it pains us tremendously to think what all may have happened previously.
She is of course not going to stay with the baby alone anymore, but I want to know what legal options I have to penalize her to the fullest extent, so that she does not do this to anybody else�s small babies. She it seems had come here last year and taken care of someone else�s baby in Hoboken, and I can imagine that their baby also went through this. (This woman and her husband are a ~ 35 year old couple, who have a multiple entry ten year tourist visa; both come here for 6 months every year and work odd jobs like this. They apparently got a (unsponsored) tourist visa after showing a lot of landed property in India).
I specifically want to know if I will have potential problems if I go to law enforcement about this- regarding have employed her (both of us are on H1B visas). I know we have made mistakes and should have done better due diligence in this, and there cannot be any more punishment for us than seeing our 8 month old � who cannot tell us about it when we come home- being beaten on the tapes. We saw this yesterday and have not told her yet. We want to weigh all options before we proceed, but from today onwards one of us is home all the time till Friday. Any advice or opinion is sincerely appreciated. Thanks for reading this long post. And, to all who are thinking of nannies or have one, please learn from our mistakes and closely monitor your child�s safety every day.

I am not arguing about who is ahead in the line to get the non-existent cake - please read my post once again and point it out to me where I said anything in such regard..
Frustration comes from the point that all the discussions take tone that all IV efforts are to help EB2 category alone. It is becoming frustrating for EB3s to keep reading posts and participating in actions when everyone keeps portraying IV effort as EB2 only effort.

Please stop using condescending remarks. I have been reading all your posts and your tone is going from bad to worst. It is not possible to place all the threads on the home page. We make a decision to put threads on the home page that we believe are important for our effort. If you feel otherwise, that is ok. But it is not ok for you to use derogatory language. If you feel so passionate, why don't you start your organization and spend your time, energy and resources and advocate for the cause instead of posting derogatory messages for others. It is very easy to fire when the gun is on someone else shoulder. We understand and share the frustration with green card delays, but that does not give you license to use derogatory language. Everyday there is new thread asking for update, leadership, direction etc. It is not practical to reply to every such post on this forum. That too does not give you license to use derogatory language. In last over 2.5 years we have answered many thousands questions in forums, emails and phone calls. I have heard many a times from my fellow team mates that not once did anyone receive a Thank you note from someone after that someone was fully able to resolve the situation after receiving reply from my colleagues at IV. None of us spend time on this cause to receive a Thank you note, however, posts like yours makes us wonder that are we a community of thankless educated immigrants who are so obsessed with our individual case that all that we want is instant gratification to exactly know the current status of our green cards, without which automatically IV is at fault. Just so that you know, people spend 30 sometimes 40 hours a week over the period of years, just to read a post from someone like you. We received a call at 12:30am yesterday from someone asking about changing to another company because his current employer was not being fair. So when you mock, please make it clear that you are not the one standing in the line of fire and you are not the one who wants to stand in the line of fire. You just wants to be the one to mock and ridicule. If you are serious about taking the baton, please let us know your phone number and we will post it on the website so that people can call you when they have a question. Lets talk about passing the baton, how about we start from posting your phone number on the website, lets see how you take that challenge. No one is paid to work on IV. People spend time on this effort out of their good-will and passion for the cause. So please be respectful towards others for their efforts. And please stop being a pain in the neck and talk some sense if you are serious about picking up the baton. Email us your phone number and you will see it on the website within an hour.

Through the school of hard knocks, I have gained considerable knowledge about this convoluted process that affects us all and hopefully what I learnt will be of use to other people in the same boat.

Around the second week of each month, a welter of activity breaks out on the online forums of Immigration Voice, a non-profit organization set up by employment-based legal immigrants in the US. Users on the site vie with each other to predict the cut-off dates for the next month�s Visa Bulletin. These dates dictate the hopes and lives of thousands of legal immigrants and owing to their sheer numbers, Indian and Chinese applicants make up the overwhelming majority of those who wait in line for employment-based US permanent residence.
Since 200x, barring a few anomalous months, the cut-off dates have largely languished between 2003 and 2004. While the annual limit of per-country allocated visas for Indian and Chinese applicants are exceeded by the number of applicants, the problem is compounded by the ongoing inefficiency of the United States Citizenship and Immigration Services (USCIS). This inefficiency occurs at many levels of processing:
1) Slow processing times often leading to wasted visa numbers that expire at the end of the immigration year.
2) Lack of transparency throughout the process.
3) Lack of customer service in spite of regular ramping up of immigration fees.
4) Random movements, spanning months and sometimes, years, in the cut-off dates of the monthly visa bulletins.
5) Lack of communication between the USCIS and the Department of State (DOS) (the agency that sets the visa bulletin).
These are some of the most glaring inefficiencies that law-abiding, tax-paying immigrants suffer throughout the lengthy process which more often than not spans a minimum period of five years. However, the most egregious of the USCIS�s faults is the apparently complete cluelessness as to the number of applicants pending in their database. It boggles the mind how an agency of such import is unable to give a definite figure to the number of applications remaining to be adjudicated. That the United States, the most advanced country in economic and military leagues, can�t account for its legal immigrants speaks to the need for more highly-skilled immigrants to improve the status quo?

Anyways, It seems I might be converting to this idea of flowers, after my previous opposition to the idea. The only flower or a plant I can think of is a Cactus, will that work?
I am talking about those three to five feet tall cactus plants, that prick you when you touch them.
My message will be:
"Dear USCIS, since the working conditions at USCIS are poor and you may not have resources to water all the flowers that you are receiving. I am sending you a cactus that is low maintenance.

2. Why do we sit down and accept what is given to us instead of asking for what we want/ desire?
3. Why do I hear - "I am not interested in protesting" or "I don't have the time" from folks that are paying a high price due to retrogression?
We are LEGAL, tax paying, resident aliens that are contributing to the economic growth and not siphoning off government funds. Don't we deserve better?
Why were there 100's of thousands of faxes sent by NumbersUSA (aka Sherman and gang) while all we could muster was a meager 20000? Where are the rest of the 1.2 million EB applicants?????

I know lot of my friends still waiting for GC since last 7/8/9 years. As you can see MY PD is Oct 2001 and I got my approval email last week.
So dont think that everyone who is getting approved with old PD has bought a Sub labor.
