    I thought I will share this. Not sure if its going to help anyone.

    Approached the entry counter where they give you token to inside and talk to IO. Surprisingly the person at the entry counter had IO written on her badge that she was wearing. She asked me reason to visit. I told her that I applied for my I-485 and have been current for this month , but have not heard anything. She asked if I was EB2 or Eb3. I told her EB2. She asked for receipts. I gave her 485 receipt and copy of I-140. She then compared my PD with copy of August Visa Bulletin. After she confirmed that I was current, she told me that my case is assigned to IO. I don't think she even entered my A# or receipt number. But I am not sure about this part because I dont remember the exact sequence of events. Anyway, I asked her whether my NC is clear. She then entered something in the system and told me that my NC was clear only last month and thats why my case has assigned to my IO. But this time she told me it was assigned on 8/8/08. She told me I should hear something soon. Did not and was not ready to give any time line. Also she did not mention anything about visa numbers being exhausted. If this had been the case she could have mentioned that.

    After that I asked if everything else was clear, she mentioned without even looking at the system that everything is clear and I should hear on my case soon.

    I dont know about rest of the stuff but I know that at least the NC info is consistent with the call I made to TSC few weeks ago. So I can at least believe that my NC is clear.

    Ofcourse, with all due respect, I beg to differ, in that I think that diversity should prevail over skill.
    From my point of view, that would be common sense. :)


    that's right the actual law had two words that could change the actual meaning of how they are supposed to do it (ie., vertical versus horizontal). Some people (i was one of them) thought that at such a stalemate in the words that coomon sense should prevail. Common sense would dictate that skill would prevail over diversity.

    However; the rules were always such that there was never any horizontal spillover but rather vertical. The main thing that changed was that the unused visas from row could be used by retrogressed countries quarterly rather then annually.

    No, it is not always a 2 month gap. Normally RD (on your receipt), the data entry date (you see online as "your case was received on..."), and ND should be in quick succession. It was only in July/Aug 07 when due to high volumes many cases (including mine) waited for data entry for months, as no center wanted to accept that additional responsbility. Those whose cases were entered in July/Aug 07, became ahead of those whose cases were entered in Sept and Oct 07, no matter when they filed or what their RD (as the receipt). People with PD in 2005 and 2006 who got GC last year were those lucky ones who cases were entered in the system in July, Aug (and may be some in Sept) 07. My case was entered in Oct 07, although I filed on July 2' 07. I did not get GC at that time, though my PD is May 04.

    That is the way green card processing works if they follow rules. The perm process is to test any candidates are available for the position. If they find a qualified person then that position will not be available. But still the company can process GC for another position if they are willing. Most companies used try to reject all the candidates to get a green card for a H1b person. But recession made the things worse. To change the situation either economy need to improve or Change the green card process. One of the option is change to point system with increase of Annual cap. That will take away the control from employers and chance of explotation is less. But point system got a negative response from Lawyers and employers.

    My american employer rejected to file PERM after ads are posted. They were supposed to befiling in EB3 and they said they found candidates so they are not going to file green card...I am totally depressed..This is the true picture in almost all american companies. BEWARE of green card.

    I remember the IO asking my spouse about being a member of a job-related professional association. My spouse used to be a member of such an organization and mentioned so. The IO then remarked that such membership is a requirement for such kind of a job. She then just let it go, however.

    You say that she asked you wife about being a member of some orog. Did the IO already knew that per her own investigation or di you guys mentioned that to her prior to her asking abou it.

    I am not on estrogen therapy, but I decided to write about the feelings that I underwent during the 3 days of the event. If you do not want to read the entire post, skip to the last paragraph.

    1. Anxiety: On Sunday, as I was making my way towards Hyatt Regency on the Capitol Hill (a beautiful and an expensive hotel) I was a little anxious about meeting new people (I am a closet introvert :D ). I was not sure if the people would just continue the non-productive conversations about Eb3 vs EB2 or India vs ROW or just be plain annoying. Boy, was I wrong!!! That anxiety disappeared in a matter of minutes after walking in the situation room. The folks were dedicated and meant business. The leadership of the core group was evident, they made sure that we didn't go off message, relatively an easy task for them since most of us there realized the importance of keeping on message.

    2.Excitement: As we started the training, people started pouring great ideas (and few not so great IMHO).The trainer in chief chased each of these ideas to its logical conclusion and without saying whether they had merit or not made it obvious for us to decide. How classy and what a phenomenal coaching style!. The talking points that we discussed were articulated meticulously and question/comments were dealt with insight, experience and facts (this one is very important, we all know what opinions are like...). This was the one feeling (excitement) that lasted through the 3 days and I still cant shake it off (not that I am trying, but I don't want people to confuse me for the energizer bunny!! - we have some one else for that ;))

    3.Nervousness: The first meeting. No, no not with the folks from Congress, but the mock meeting at the training session. The veterans gave us a demonstration of their insights/ knowledge and quick wit. So of course I was nervous coming in after that performance. I volunteered to be on the first ones of these mock sessions and felt all eyes in the room on me. I tried to focus on the task at hand (which was at that time, to stop my legs from shaking ;)). Perhaps, the mock session was the toughest of all the meetings that I had on the hill (remember that the hotel was 'on the hill' too :)).

    4.Awesomeness: This is what it was all about. For me as a first timer, entering the hallowed halls of congress and participating in the democratic process up close and personal is an awesome feeling. Just walking down those corridors and noticing the closed doors with signs that say 'Appropriations Committee', or 'Democratic Caucus' and knowing that laws that affect lives of more than 300 million people are being crafted, debated and being voted on right there....what a rush. I think this too will be with me for a long long time.

    5.Camaraderie: This is a fun bunch of serious people on a mission. I think mostly everyone hit off well with everyone else. I made a whole bunch of acquaintances that I feel could mature into strong friendships. Even though we worked our collective butts off, there was always light hearted humor floating around. It was great.

    6.Gratitude: Looking at the hard work put in by the countless tireless volunteers was a humbling experience. These very kind souls put in hour after hour of work during the event but they put in even more before the event started. I don't know, if the rest of you know, organizing an event at such a scale is a massive undertaking and despite hiccups we came out the other end in great shape. My gratitude goes to all the people that put their hearts, minds and souls in allowing our community to participate in the democratic process at the highest level. Thanks for making this happen.

    Why am I writing this you wonder (or may be not). This event changed me. I felt myself grow in these 3 days. I rubbed shoulders with some of the most famous and powerful men and women in the nation and conveyed our message. I also saw first hand the resource constraints that IV has and how they figure something out and make it happen. Trust me folks, it is not easy to work thanklessly for days on end for 18 hours and still keep a cheerful demeanor but they did. My sincere thanks to IV leadership, all the fellow volunteers and all monetary contributers for allowing me such a great opportunity. Part of me hopes that we never have to do this again, but that hope also makes me sad that I probably wont get to experience a full gamut of feelings again.

    You cannot expect to report the crime/video to the cops without any repercussions for yourself. It is a federal felony to hire a foreigner without employment authorization (even if the person is not an illegal immigrant) - this means, if you are convicted, you can end up in prison, lose your property, pay fines and of course you will be deported. If you have been paying them and did not disclose this to the IRS, both you and they are liable for tax fraud, in addition. This is very serious. You should hire a lawyer if you want to deal with them legally.

    I'm not sure if I'm eligible to apply for Master's quota. I'm done with all my degree requirements and I've scheduled my thesis defence on MAy 20th. Is it still possible that I can apply in Master's quota. I've a letter from my schools which states that I'm done with all my degree requirements and I'll be finishing thesis on May 20th. Is this letter enough to apply for MAsters??

    I like your idea of the poster. I sent letters and cards so far, but didnt get this idea that catches quick attention more easily. I support you.
    I will be doing some posters myself, one of them will be a scene of not buying a 300K house, just because USCIS is not clearing my case. I am really one of them, and I know there are many many more who pay roughly $1500/month on rents, but are just waiting for this mess to be cleared to be sure, before taking such a step. Show it such that the economy also benefits in our posters. Not just what they can do for us, but also what we can, in case they help us.

    ALLOW EVERYONE TO FILE I485 SHOULD BE OUR NUMBER ONE PRIORITY.
    You people already have filed 485 and have EAD. EAD gives you so much freedom . It is as good as a green card.

    What about people who are less fortunate and cannot file II485. We need to allow everyone to be on the same page first and enjoy EAD freedom.

    That should be our priority before any country limits or this thread action item

    I now see why you got a red.
    So basically you are also supporting this " If I am in INdia now and waiting for H1 visa, then start a campaign that everyone gets a H1 and then you worry about filing 485. You all have H1s and look at me".

    The above part of your submission is not true. If you read the I-485 Adjudicator's Manual, you will find that the file is already opened and input into the system at this stage. Otherwise dwhuser would not have received I-797 Notice of Action.

    In theory action on a case should be sequenced by priority date and then received date within the priority date batch. However, nobody knows for sure how USCIS works each case.

    fromjaija, When data is entered, and the notice is generated, only limited information is entered in the system. PD is not one of them. When I said "file is not opened", I meant that no one has yet reviewed the file. Note that for most cases PD is not a controlling factor. It is only the unfortunate ones from retrogressed countries that they have to wait for PD to be current. For everyone else, once file is reviewed, if all documentation is in order, case is cleared. Once a file is reviewed, if it has to wait for PD to be current, it is placed in sequence of PD. See USCIS SOP on the link below, which even tells what color of paper clip to use, etc. (though it is a bit out of date).

    .... Our 5 PM meeting was with a Congressman himself and had a Core team member, myself and another member who was later offered an unpaid Internship by a lobbying firm. Just when we were wondering why the position would be unpaid we were told that the reason for being unpaid was because the green card process for the member accepting the position would be reset since it would not fall under same or similar category which made all of us crack up.

    Was this intern an IV member or was this intern a member of the staff - and is the lobby firm that hired him working on fixing immigration issues?

    Our closing meeting went on until 11 after which each one of us took our Action items and next steps to take back to our districts. Everyone we met over the past couple of days told us to keep up the work we have been doing for the past few years. Good work and great follow through always leads to good results.

    Couldn't agree with you more on this........ I am a member of my state chapter - are there any follow up actions that non participating members can take?
