hi october2001,
Did you use PO box as address on I-485? I had heard USCIS does not accept PO box as address in I-485.
Apparently not. If he did, the welcome notice would had got to him at the first place.

This is what my attorney told me:
4 Year Bachelors in India + 5 years of Exp (excluding sponsoring emp)
3 Year Bachelors in India + 2 Yrs(Msc) /3 Years(MCA) + 5 years of Exp (excluding sponsoring emp)
4 Year Bachelors in India + US Masters + 2 years of Exp (excluding sponsoring emp)
All these qualify for EB2. Just make sure you Job Description requires eb2.
Also, consult with a leading attorney and show you employer, that this is doable.

Leo07,
Thanks for the ideas.
Lack of contributions will reduce our investments in lobbying efforts and that will hurt our chances of overall success. In the last 3 weeks we have received just above 2K. This will be hardly of any consequence when you buy lobbying benefits from the top firm in the country. We will simply invest as much as we can get from members. If members pay us less, we will be able to get less. Provisions in the Omnibus bill are not going to be easy.
If anyone has any doubts about how much we are feared by our opponents they can read

1) On our own IV site, we can consider adding google ads only on Forum pages. However before that we need an assessment from someone that is an expert in google ads to calculate how much we can earn via google ads. Experts in this area can contact us.
2) Advertising is expensive and we cannot afford it. If anyone has contacts with websites, pls use those contacts and get us free space. We can put banner ads on those sites
3) We had $20 as a minimum amount and even then we got only 300+ people to pay. Infact, since most who could have contributed more, only contributed $20 our contributions went down significantly and we were unable to keep up with the Lobbying expenses. At that time several people complained that $20 is too high and it should be $10 or $1. This has been discussed several times on the forum and we have answered many people same question. If people think the value of the effort we all are putting and the price of increasing the chances of their greencard is just worth $20 or $5, then I do not think we should even pursue this effort and even keep this website up.
4) This is a good idea. Next time I start spotlight thread, I would request members to donate if they found the topic helpful. Likewise all active members who help others on the forum by answering their questions can request readers to consider donating if the answers were helpful.
5) This is tough to implement without knowing who is conducting such campaign and if the person can be trusted.

hi,
my parents will be travelling to the US in a couple of months, and I was looking for health insurance for them. Based on various forums, looks like US companies are preferable to insurance bought from india (and as per forums, ICICI lombard seems to have the most negative reviews among the indian firms).
Anyways - has anyone used insu buy .com to buy medical insurance for their parents, and had to make a claim? They seem to be an insurance broker -- so the insurance company will be a third party, but they (insu_buy) seems to claim that they will also help out with claims in case of any issues.
Anyone have any experience buying + claiming insurance via ? (and if so, what was the insurance company that sold the claim via ?)
I searched immigration voice forums for "insu buy" but though there are many threads about medical insurance for parents, there doesnt seem to be any mention of -- so any experiences shared will be helpful.
Thanks in advance!
PS: Looks like the IV forum is automatically filtering out [insu buy] and [buy american insurance] if i remove spaces from the words -- probably an anti spam measure. Hence i've put spaces between the "insu" and "buy" & between "buy" and "american insurance" -- without it, when i preview my message before posting, the words seem to get auto filtered out of the message!! (anyone seen anything like this before?!!)
Are you Millionaire?Do you have lot of money or lot of savings? Even with US passport the moment citizens cross 50 years they are on death bed in US. One hour in emergency room (just hello and goodmorning) in public hospital cost $1000.Its a capatilist country and they dont care about people and even citizens. If you come to US then dont get ever sick. I know in Canada and UK taxes are high but when you need services NHS and other agencies are always there to help you and protect you. It takes 1000 days in Canada for parents to get PR and after PR they are all eligible to use Canadian free public health system.20000 pages of new Obama's health care reform and it does nothing regarding pre-existing conditions, immigrants, high deductibles and aged US citizens.Even full time employeed people with employer insurance really have to fight very hard to get their insurance pay for necessary medical services in US.Its because all insurance companies are always looking for bogus and false reasons to just deny even ligitimate claims.
I strongly suggest all indians and immigrants to please dont ever grow old or sick in USA otherwise your American dream will give its real nightmare reality.

Hi Will Win
Don't you think if the EB system here was fixed, IV would have been able to focus on CP ?
We all need to stick together to help each other.
Thanks
There is an even a more direct benefit here I think. If the bills pass, dates move forward for everyone both AOS and CP.

Your comment is proof that even the best education money can buy does not make up for being short on common sense, decency and respect. Perhaps you should attempt another Masters, and shove it where the sun never shines. It's stunning, some of the "educated" prima donnas who make up this community.

I am wondering the same for 2002 applicants. I wonder if many people were approved in 2007 fiasco and if yes, then why PD is stuck at Nov 2001?
I am also thinking the same that many might have been approved in 2007, because most of these applicants had a chance to apply before the gates were closed in 2005, and would have been approved in 2007. But 0 responses is still odd.
The reasons for Nov 2001 PD could be due to backlog processing centers that held sway over these applicants (non-RIR cases), but by same yardstick, there still should be some cases in early 2002. Odd indeed (though a good kind of "odd", as we will get a welcome jump in dates once they ball starts rolling).

visves, Longq, alisa...
We have a difference of opinion on how the law is interpreted....
I believe that visves interpretation is correct....But there is always a small chance that longq does followup with a lawsuit, USCIS would budge...
if longq wants to gather some EB2 India/China and have a crack at suing USCIS as a personal level....( i.e.not using IV's resources).....I guess no one can stop him...I am EB3/India....So that suing does not benefit me anyway...
The common denominator for all of us is increasing the total numbers......
If members want to pursue certain things on their own at personal level..I cannot do anything ...after all it is a free country...
There are other quirky ways the law is getting interpreted. Why are India, China, Phil, Mex singled out in the Visa bulletin and reported separately? Where I work there are as many Russian programmers as Indians and Chinese. Judging from how long it is taking my Russian colleagues to get their green cards even they are retrogressed because it takes them more than 5 years. But because they are bunched with ROW, they are Current in EB2 and can apply for 485 and their spouses can get EAD and work.
If it is only 2800 visas per category per country.. lets be real.. even UK, Pakistan and other countries will be sending more than that number per year. But they are all bunched in EB2 ROW and can happily apply for EAD for their spouses. Not only that, they can even participate in the diversity visa lottery from which we are excluded.
The problem is that we are trying to ask for too much and nothing will happen. First we have to get them to be transparent about how they interpret the law and make them release more data. We dont even know if we are being treated fairly. It is also unacceptable that we dont know how long we have to wait before our spouses can work. If we dont have correct data what are we actually fighting for?

I am little bit worried because IO needs to go to HO and get approval before they can approve an applications due to pending name check over 180 days. there was law suite and Judge has forced USCIS issue green card if name check has been pending over 180 days but, there has been new memo from USCIS field director and IO has to write to HO and get approval in these cases.. I am not sure whether an IO will be willing to go head office for an applicant.

Thanks everyone for the feedback. Can some guru put this issue to rest? I guess the only question that remains is:
"For a person who has extended his H1 beyond the 6 year category on the basis of AOS, would this H1 extension be valid if I-485 is denied (either wrongly due to AC21 or otherwise)"
Hi Indyanguy,
This is an excellent question and I was also looking for an answer. I am into my 6th year of H1-B(exactly 5 years 1 month) and also have an approved EAD & AP.
I have a great JOB offer but hesitating to invoke AC21(moving using H1-B/EAD) because these days there are many 485 DENIALS( the moment I1-40 is REVOKED). And NOTHING is guaranteed even if we send the AC21 documents to USCIS. And the EAD automatically gets invalid anyways when the 485 is denied.
Doing some research to find out if H1-B extension beyond 6th year is valid if 485 - gets DENIED? (Example: If I get a 3 year H1-B extension based on my current I-140 approval)?
Also not sure if it applies in my case as I still have 10-11 months of H1-B remaining and if I decide to take up this oppurtunity in the next couple of months and 485 gets DENIED after that. May be I will have enough time to file MTR? I should be fine. But what if 485 gets DENIED after I complete 6 years?
Please provide genuine answers.
These answers will BENEFIT many people.
Thanks in advance.
Cheers,
Srini

GOP senator: Filibuster guest-worker program
Arizona's Kyl believes there might be enough votes to block legislation
A filibuster by Republicans is in order if President Bush presses forward in the new Congress with legislation to establish a guest-worker program with a path to citizenship, says Sen. Jon Kyl, R-Ariz.
Kyl, however, speaking yesterday to nationally syndicated radio host Laura Ingraham, said he was uncertain whether or not Republicans would have the 40 votes necessary to block the legislation.
"I would certainly hope that the majority of Republicans in the Senate would not be complicit in passing legislation that is not wise, that for example, would put everybody on a path to citizenship and say that temporary workers get to get U.S. citizenship, and so on," Kyl said, according to HotAir.com
In January, Democrats will have a 51-49 majority over Republicans in the Senate. A supermajority of 61 votes would be needed to prevent a filibuster.
"I would certainly hope that we would have the 40 votes to be able to stop [the legislation], but, I don't know, we're going to have to wait and see; it'll be very close," said Kyl, who won re-election to another six-year term last week.
Arguing for the guest-worker program, the Bush administration has insisted it's not practical to deport the millions of foreigners who are in the country illegally.
"The cost of identifying all of those people and sending them back would be stupendous. It would be billions and billions of dollars," Homeland Security Secretary Michael Chertoff said in an interview last year.
"One of the reasons I think that we've been focusing on the idea of a temporary worker program as part of a larger strategy for border security is because it would be a way to siphon off people who really want to do nothing more than work here, put them into a regulated program we would know who they are we would then be able to send them back at the end of a period of three years or six years," he told Sean Hannity on the Fox News Channel program "Hannity & Colmes."
"They would have made some money, they could take it back home, and then we could focus our other resources on the people that don't want to do it the right way, and we could get those people sent out."
Last May, just 36 senators three of them Democrats voted against a bill that included a guest-worker program. The Senate was unable to work out a comprise before the Nov. 7 midterm elections with the House, which passed legislation rebuffing Bush's desire for foreign workers to gain legal employment.
Last summer, Rep. Mike Pence, R-Ind., announced a compromise plan called the "No Amnesty Reform Act," which would require all illegal aliens to leave the United States and apply at "Ellis Island Centers," operated by private companies in Mexico under a license from the U. S. government. They would then obtain a "Good Neighbor Safe Visa" qualifying them to re-enter the U.S. as "guest workers."
As But members of a group called the Secure Borders Coalition have opposed Pence's proposal, labeling it "amnesty lite." The group argues the plan would provide for the "wholesale importation of aliens and a path to citizenship for them."
Minuteman Project founder Jim Gilchrist told WND in August he believed the result of the Pence plan would be to flood the U.S. with millions more illegal immigrants.
"Probably within hours of the Ellis Island Centers opening, counterfeit copies of the required documentation to re-enter the U.S. will be available on the streets of Los Angeles and dozens of other U.S. cities," he said.

Thanks for the effort.
I posted my comments and my story (with links to couple articles that were published sometime back about my case in a newspaper).
Lets add more stories. As someone already suggested lets concentrate on how our GC can contribute to the economy - buying a house/establishing a company/etc. I also quoted some of the recent studies that showed how immigrant entrepreneurs positively contributed to the economy (couple links from IV).
