vfs received my passport today i.e., Dec 18th. Dec 6th 1400 hrs was the H1b appointment.

Logiclife. I know why you are responding to these comments you all are frustrated with such comments. I know it is hard to not respond but please ignore these asinine comments. Please have some of these comments linked to the main page. But believe me "barking dogs seldom bite." Such people will ultimately sap your energy. But, just like how IV is asking people to contribute please also ask them to use their own judgment, they do this at their own risk. There are many people like us who have faith in your group although we know you cannot do miracles. I think there is another issue here. lets say you file for your 485 and you get married later in teh year..by that if PD retregresses again, your spouse wont be able to file for 485, since she gets your PD. so you might get approved sometime next year and you will loose your h1b status, then it gets to be a problem for the spouse since she is still waiting for PD to retrogress..so please talk to a lawyer and get all the facts...

A lawsuit isnt the answer to everything. The chinese EB folks learnt that after spending thousands of dollars and few years on their lawsuit, the judgement they got back was that 'the law is being followed'.

Filed to TSC in January 2008 and I just got the RFE from TSC for my EB1-OR
petition:
It says:
"On the I-140 submitted, you failed to complete th form as requested. On
Part 5. Additional information about the petitioner. You did not complete #2

companies of 100 or less employees, the petitioner must submit the last two
recent quarterly reports which lists employees; wages and social security
numbers as evidence to ability to pay proffered wages.

I worked in a small start-up company with 20+ employees. The company has

140 form part 5, #2 I put "0.00" for both Gross Annual Income and net Annual
Income according to the information I got from my employer.
The lawyer I hired filed my I-140 (I got signature from my employer) WITHOUT
my W-2 form or my last year pay-stubs. In stead, he attached my W-2 form
and three month pay-stubs with my I-485 application.
Now my employer refuses to give me those financial statements listed in the
RFE letter, what should I do?????

Did you guys paid attention to this, when Inflation rose to 13% Indian Finance Minister said it is because Oil is at $160 a barrel, but now as Oil has come down, Inflation has come down worldwide Inflation is still above 12% in India. also, when Stock markets were at 22K Indian FM minister used to give Interviews every day it is because of great policies of UPA govt. Now Sensex has slashed 40%, Finance Mn. has suddenly dissapeared. Did you guys also heard him saying 'Indian economy is insulated from ongoing US crisis'. This is truly unfair where country of birth determined who gets an 'Employment' based greencard before someone else. It can only be fixed by eliminating per-country limits.

Seems like everyone here hates ICICI... I have been using ICICI for 8 yrs now...Had no issues transferring money..... They might have robbed me few paisa from exchange rate but i did not pay that close attention as i found that exchange rate at remit2india from times and Citi was always bad compared to ICICI. I do know about their bad practices in India where they force people to have min balance of 10-15 K and so forth. I think its time that RBI makes gets rid of min balance requirement or put upper ceiling on it. Having such a large sum (Equivalent to 2K USD when considered Purchase power parity) is ridiculous and kind of stealing of people's hard earned money. But again, ICICI is not the only one doing it so cant single them out.
After reading so many bad reviews about ICICI, i would like to check out SBI service, but not sure if they allow direct deposit in banks other than SBI? my parents are with IDBI so it is very convenient to have ICICI transfer money directly....Please advise

there are two factors here:
1. Regarding consultant coming to US. As employer told he does not have bonafide job offer. he is at 0% fault and consultant 100%.
2. Regarding paying for h1b fee. employer obviously did not make money here but he was not supposed to take money from consultant.
it's all about greed on both sides.

My attorney sent the I-485 papers on 7/16 and it reached NSC on 7/17 at 9:36AM. USCIS announcement to accept the applicatons was done on 7/17 evening. Will mine be in the potential rejection pile? Any input will be appreciated.

Hi Gurus,
I need an advice from you.
The situation:
-- Involved in a collision few months back. As I had rear ended the vehicle, as per the investigation, it was found it was my fault(80% mine - 20% others)
-- Now after more than 18 months, I get a law suit for 3.25 million dollars(. This was served against ppl who were involved. Right now my I have my EAD and AP and maintaining H1 status.
So what are my options now?
1. Check with attorney and start defending..?
2. pack the bags and go back to my country ? If so, will there be any issues in coming back again, say after 3,4 years?
3. What about my GC?
Any help would be greatly appreciated and I guess it would be a biggest decision of my life ..

It is very difficult to make a prediction...The 7% country quota for china is satisfied already...So it could be this october
The only chance that it happens is that visa overflow from other categories into EB2China/India...For that to happen..Eb3 world has to become current.....
That would mean that more visa are available than can be used for Rest of world...Then CHINA/India would get some more than 7% country quota....
So it could be Oct 07 or if you are lucky... earlier....
If immigration reform happens..you would definately become current immedialtely...

In my case, I travelled back on AP as my visa extension stamping went pending in Mumbai consulate. Came back here with my I-94 indicating "Parolee" as my new status.
Within 2 weeks, I changed employer as per AC21, they filed for my H1 transfer(premium processing) via Murthy Law Firm. I received a new I94 which put me back in the H1B status. During this 2-3 weeks I was in the US as a parolee I did NOT use the EAD, because you don't have to.
Interestingly after 3 months of my visa application at Mumbai consulate (2 months after I reached US) I received an email from them asking me to submit my passport for stamping. Its unbelievable that they think applicants would still be waiting in India for 3 months and that their employers would still be interested in keeping them, but I guess after all this ordeal I realised, they just don't care.

It took me around 4 years. EB2 India, started as a scientist later physician and endless headaches ...... but its over now. Got my card yesterday. Its an amazing stress relief and confidence booster.
I could have tried EB1 too but wasnt sure how it would turn out hence stuck to EB2.
PD Dec 2005, EB2, RD for 485 Sept 2007. Welcome notice August 5 2008.
For some odd reason I got a red on this forum. I dont know who did that and why. But I dont care.....
For those who are waiting: Keep pushing and thinking of new ways of making this work. if you are EB3 try to become EB2 and even EB1. In the end all that matters is getting the card.
As regards this forum. I never contributed but found this to a good source of information.
