Don't forget there are a few H1Bs who are hired in research, govt, non profit, universities, etc who do not come under the H1B quota. Even they want GCs, :)

In any system if you club large group of applicants based on a dichotomy, and say you will get lesser share than the rest, isn't that how you describe preferential treatment ? Is there any other way to describe the current country-quota system?

You probably can't ask to stop portability from EB3 to EB2 or EB2 to EB1. But you can ask for if filers from EB3 goes to EB2, they can't keep the PD from EB3 but get a new PD for the date USCIS process their EB2 application.
That will make people really think if that is worthy to do so. Otherwise every EB-3 filer will want to file again for EB-2 if they can.
You can ask all you want about not allowing porting from EB3 to EB2 or not letting keep the priority date in doing so. IV is not going to endorse it. Reality is job done by EB2 or EB3 especially in IT is very much alike.
Moving from EB3 to EB2 is for worthy cause of getting GC faster in legitimate and ethical way.

Exactly same thing is going on with me, getting a soft LUD almost every day! (to be precise three times since they received my RFE response). Not sure what's going on?
Ok here is my experience,
had a hard LUD and received RFE for 325A and birth certificates,
Replied to RFE - USCIS received the mail on the 8th, same day in the evening, received a hard LUD saying, RFE response received and is under process.
Till today, I have been seeing soft LUD on our case, I dont know what is going on !!!

To alien2006' posts I want to add the following:

1. Prospective H1 employer suggests the following (nothing in writing of course):
"Great. You are very smart and deserving. We have choosen you to be one of the lucky few whom we will take to America this year after filing your H1-B visa. Once you land there on the H1-B visa, everything will be great. You will have a job in a few days with one of our clients (Buzzer - this is one heck of a lie - there are no confirmed jobs - one has to go through the whole process of interviews again to find a project where you will be accepted on a contract position. Rarely I have seen H1 companies who have projects of their own for their employees...but no one tells us that!!!). After you have worked with us for about 6 or 7 months we will file your green card and you will have your green card within 3 - 4 years. You will be all set with the wonderful American Dream in less than 6 years which is the validity of your H1 visa!!!. Waiting for CIR bill for EB relif is not worthy. It will unlikley be passed in lame-duck congress, as t needs heavy conference. It may be the good idea to push SkIL bill or somesort of EB relief provison (like budget reconcilation bill last year) in other bills to be passed in lame duck period.

I bought Patriot America by img global for my parents. We had to take my mother to ER. The total claim was close to 10k and to my surprise imgglobal did pay exactly as whatever it said. It is not a pre existing condition. Based on my research, nobody covers a pre existing condition.
The advantage of using the american, comprehensive policy is, the hospital took the insurance card, no questions asked. Send me a PM if you want more details as it was really painful in the first place to go to ER, let alone worry about insurance.

Anybody has this situation?
My case was sent by my attorney June 29th (current July bulletin) USPS certified mail.
As per USPS online tracking record it was delivered July 2nd 12.45 PM.
No receipt yet. So far sounds okay.
But I got the copy of actual delivery receipt stamped by F.Heinauer (Director NSC USCIS) with the date 062907.
It is a stamp so some of their employee clearly has stamped it.
Now I am confused if that�s the receipt date they are going to go with and may reject the application.
And with this many application it may take more than AUG 17th to receive anything back.
I am very sure it was reached on July 2nd. It was only sent June 29th afternoon.
And USPS is telling there is no delivery can reach so fast. According to USPS the guy who might have stamped the delivery did not changed the stamp date from 0629 to 0702 since it was a weekend.
Anybody in the same situation? Any advice?

There's a book put out by three 'scholars' from the Manhattan Institute with an innocuous title and everything else inside it anything but! Given the complete lack of spine or commonsense of IV browsers, one can only hope this is just an ugly cycle that plays itself out and decent people recover their sensibility

This might come as a surprise to some of you, but someone needs to say it out loud. GET A LIFE FOLKS!!!! there is more to life then EB, GC and all. it seem all we desi's can think of is how to get a green card so we can live here with peace and never have to worry bout getting laid off or anything.
Few points:
1) having gc is a privilege not a right.
2) US has every right to choose whom they want to have in their country.
3) If getting PR or citizenship of a western country is the goal there are many countries which have a fair point based system.
4) Considering the number of fraud's committed by Indian body shoppers and people who use them, i am not surprised USCIS is extra careful when it comes to Indian applications. Anyone who got his wife with no exp with software dev an h1b visa from some cheat in Jersey knows what i am talking bout . My freind got his wife an H1 after showing she knew software testing even though her major was fine arts and all she was good at was web surfing :)
5) have a back up. i came here in 2001 as student and have seen it all. I am on h1b since 2004. i knew we have too many people whose sole aim in life is a American GC. to avoid becoming one of those who check processing dates first thing in morning, i applied for Canadian PR, got it in 8 months and i am not even gonna bother applying for labor, i-140 and all those precious life controlling documents.
Wake up friends, you have options. Don't let your life depend on you application status.

When one switch employers using H1 transfer, the previous employer has to notify USCIS that you are no longer employed with them. The soft LUD's that you are seeing is a result of USCIS going back to the old employers and confirming that you are indeed not working with them...

Probably most of you are aware of these things. So, let me say this advice is for newbies in the job. Lay-offs are done for business reasons and cost considerations. An American friend of mine lost his managerial job after 18 years of loyalty and experience. Company did not see the reason to continue to be in that business and the entire division related to the business was laid off. So working hard is good. Definitely a deserved trait. Do it for self-satisfaction, but not out of fear of loosing the job. At the same time, we should not be cloistered within the company working long hours. There are other things imprtant in life apart from the eight hours we spend at the office. I tend to my hobbies to keep my sanity after work. I look out for business indicators/news regarding how my company is doing. Good financial planning mandates savings around 6-12 months of living expenses which would lessen the impact of lay-off.;)

I was fired in less than a minute and I was in 6th year of h1b. LOYALTY TO JOB MUST NOT BE FOR THE REASON THAT THEY HOLD YOUR VISA AND GREEN CARD. I moved out to consulting company and now work on %age and now I don't really care about being artificially loyal to any client. This is more healthy, resume gets built and you do not have to worry about losing your visa and status as long as you are in project, and as such changing projects is not difficult these days.
Most of the immigrants tend to be artificially inclined and have love and affection towards their companies just because Green card process is going on. Companies love to be cuddled by you but will not go out of their way for you.
The very reason logiclife and other folks started this group is because we are on our own. It is a fact that we are at no advantage with retrogression. Offcourse there are choices and one always has choices. Keeping quiet and accepting crap is not right. Whether we succeed or not, we must not accept crap as "fact of life". There is a saying "If you can walk, you can work".
I also agree that "working long hours + artificial loyalty" on h1b just for a GC is not proper reasoning for this cause. The actual reason behind this cause is a broken system that definitely needs too be fixed.
