The bigger question here is .......Are there any IOs sitting at the fingerprinting place . If yes, are they authorized to give out such info or even entertain any such requests ??
That is incorrect for my local ASC. I know that for sure. When I went to ASC for FP I do not think they were capable of answering any case related questions. All they do there is take FP notice , stamp it and do FP. They ask you to goto local office for any questions related to your case.
Secondly how come the IO had the authority to show an internal memo to a customer. Does it make sense?

We have been fooled so many times in the past with the predictions of the visa allocation being over etc. I would take this with a grain of salt.

You may have the right intentions and your heart might be in the right place. I am at a loss to understand the philosophy of your approach. I get it that in numerous previous 'campaigns' people committed to funds/help but failed to come through with action.
But I question your approach and the need for such scathing attacks. Please do some research and see if historically, 'tough love' or hurling insults has motivated people. The answer is a big fat NO.
A leader has to influence people to go from motivation which lies just below the threshold to a desire to cross the threshold to action.
Why do people decide on acertain course of action and how this turns into committment? It is known as Volition.

I like your idea. And I do support it in spite I not being in similar situation.. However with a little bit experienece I have with similar work flow improvement projects I would like to point out that the impact on labour/cost has to be thought through. My understanding is the agency has not been using Visa numbers because they are heavily loaded. Now if you ask them to do this pre-adjudicataion for all cases that will impose a sever load on them. I may be completely wrong here - it could be another department, another agency so this may not be an issue at all.. but if possible think through this as we submit a proposal.. If needed (now gals and guys don't beat me up!) we could even pay them (So they could hire people) to get this pre-adjudication done?

I was there for the three days (though I was very late on Sunday). This was an exciting experience for me. I was involved in 10 meetings with the lawmaker's offices on Monday & Tuesday.

This achievement of IV and the legal immigrant community shows what a small organization can do to move the goliath and change the world.
But we need to know that the war is far from over.

Let me add my observations here:
For people who doubt where all the money is going, remember Aman founded this organization putting his own money into this ( not in hundreds but thousands). He and some other core members has already got their green cards, but they continue to work for this cause. I also remember Aman and core members saying this "It is not about you. It is about the community. You just don't think about yourself, you work for everyone." Most of the talk points for meetings were meant for relief to the entire community, not a specific group.
For me, I had to go for a meeting alone. Initially I was disappointed, but I could handle that meeting very well, thanks to IVs training session. For those who are apprehensive about attending these meetings -- It is pretty straightforward if we follow IVs talking points and presentation style. We cover ourselves well with arguments and counter arguments during training session.
As for meeting lawmakers, it will always be a pleasant experience. This is the greatest democracy on the face of the earth. Lawmakers will lend a patient, listening ears to your issues. No worries there. Also fixes to our issues will benefit not only us, it will help this country in the long run. If you haven't met your lawmaker yet, please plan meeting them and let them know your pains. A meeting from a constituent is very valuable for these lawmakers.
A request to IV core:
It is better if IV could conduct the training in different state chapters, so that people will feel more confident and less apprehensive in meeting their lawmakers.

Since the dates went back ppl wake up and say now I want to shoot this bird, not knowingly how many cases are there... A simple question to you, (I know the point this thread is raising is going no where becoz for years many ppl discussed this and at the last USCIS deciced to stop this forever which is indeed a good move).
Will all the ppl who came after ppl stuck in BEC (Labor) will go back the line ? will they relinquish ... A simple answer "NO" So why are we debating on items that doesnt exist?
IV for now has only one goal "recapture". There is no way USCIS can go back and change the dates who ever used Subs( I am not talking about FRAUD- FRAUD shouldnt exist period) as per law the dates should be ported.
The intent of a subst labor was to save the company time and money for obtaining another labor for the same position in case the original beneficiary drops out. Remember, labor was a company petition, not employee petition. The companies still would have wanted it even if it does not retain its original PD.
The basic thrust behind the idea of changing the rules of PD allocation for subst cases is to push forward PD to july 07 level. Most of the subst happened in that month. we are not asking subst labor folks to quit the queue, just asking them to move behind.

thanks for the info. both me and my wife were issued an rfe in March for which we responded early april and then again it is in a holding tank since then. hopefully we are done with the rfe nonsense and are at a place where we can be greened.

Senthil has articulated legal basis of current system. However, many members feel agrieved by current situation. My displeasure with current law was based on my perception about principles of natural justice and a dogma that one measure (current provisions) should not negatively impact others basic rights for happiness, equality, nondiscrimination etc. Courts could take a look at how much damege or injury is possible or actually already resulting (stalled careers, family separation, life on hold, creativity-innovation halted) in current system. Atleast it will open up healthy debate and rational measures to address genuine problems.
Could anybody clarify as to whether counting of family members towards annual quota is mandated by congress or it is an administrative provision.

As in the scientific world, peer review and criticism is taken seriously in this country. By law suit, we are trying to create peer review or honest analysis about this impasse. No body wins but the truth and humanity.

It may be also possible for EB3 to interfile or refile for EB2 and take advantage of old priority date and shorten the wait. there is ot a magic wand. We could help our administrators, law makers and law protectors and law upholders to make appropriate corrections. Hence, scientific and rational dialogue through fair and just means is our focus.
Let us highlight our difficulties in a logical way. Go about living normal life but stand up for something you believe in.

DOS has already allocated the available visa numbers for this fiscal to qualifying pending cases. There are are no more visas left to allocate.
It is still completely possible that there are ~ 14,000 pending cases with visas already allocated - simply awaiting approval by USCIS.

I am EB3-I (pd 02 retrogressed) but was interested in this discussion so i emailed my lawyer about it. She said, historically the last month of the fiscal year has the most approvals as they try to clear as much as they can. You will see a lot more approvals from next week or sept 2nd week.
