Long as you are married before your 485 is approved you should be ok. What is your PD and category?
One hint they give you is when they send the fingerprinting (FP) notice. You can't be approved without that. And after FP it takes any where from 3 - 6 months.
I am getting married in Jan 2008. can i go ahead and apply now? How to include the wife? will that be a problem.

Armed with bipartisan support, an Arizona congressman is moving ahead with legislation that could solve a series of illegal immigration issues.
Rep. Raul Grijalva said the measures will be introduced soon and would provide expedited citizenship for active duty military members who are not U.S. citizens, and permanent resident status for their families.
House Resolution 6020 would help some of the more than 45,000 noncitizens serving in the U.S. military as of March 2007, said Grijalva, a southern Arizona Democrat.
``Some families fear immediate deportation if their noncitizen soldier is killed on active duty,'' he said.
The bill would permit family members of such soldiers to become lawful permanent residents.
A second bill calls for basic health care for detained immigrants.
House Resolution 5950 would set medical care standards for immigrant detainees.
The secretary of the U.S. Department of Health Services would be required to establish procedures for the timely and effective delivery of health care to detainees and to report the deaths of detainees to the agency and Congress. It would require any necessary medications be provided upon detention.
Grijalva may not he done yet. The congressman said he is considering co-sponsoring two more immigration bills that have bipartisan support.
One eliminates the per country limits on foreign workers who can obtain employment-based visas to work in the United States.
The second would allow about 12,000 masters or doctorate-level graduates of U.S. colleges each year who are noncitizens to obtain green cards to work in science, technology, engineering and math.

i dont understand......why did you choose to go through this hell??
can you please explain??........i thought france is a developed country with almost same opportunities as USA??
if someone from somalia.....goes through this ordeal its understandable.....
People choose to come here for plenty of different reasons: professional, economical, family or a combination of everything.
Yes, France is a developed and rich country and, if I had stayed there, I would certainly be today in a much better situation, professionaly and financially!
So, I certainly did not come here for the $$. It is extremely simple: it was just my childhood dream to live here and I am proud today that I made it.
Yes, I had to go through that ordeal and I did not "choose" to do it, it just happened. I was just stuck in that infernal situation.
Would I do it again, even to fulfill my dream? Certainly not, I am not that mad. Will it prove worth it eventually? I don't know yet.
The truth of the matter is: how do you know in advance what lies ahead?
If we always knew, life would be too easy, don't you think so?
Nobody would make mistakes or wrong choices.
So, was I right or wrong to go through all this? Well, again, I don't know.
Time will tell...

"USCISs announcement today allows anyone who was eligible to apply under Visa Bulletin No.107 a full months time to do so. Applications already properly filed with USCIS will also be accepted."
This clearly says applications already filed will also be accepted. So this means anyone who filed between July 2nd and 17th will not be rejected.

Should I say that all of you those who bought homes and are having a life bought a home with 0% down and interest only loan so that you can save your taxes now and if your GC does not come through in 5 years, you will walk out with out any loss as you made hefty deductions and haven't paid single penny towards the mortgage and simply go to Timbuktu or Krakovia. I will not!.
Thanks for calling me a hypocrite with out reading the whole answer. I was just giving a hypothetical example on how one can talk about others life and practices in life sitting before a computer. Thanks for your clarification on whom you considered XYZ because lack of GC has stopped them from buying a home. I will respectfully disagree with your opinion that GC is not a non stopper for every one and there is a significant contingent out there who dont want to buy a home without a GC and consider it risk. Opinions differ and yours is taken. Again, You in the above hypothetical example does not refer to any one in person.

chaanakya i fully agree with your assessment!
Yes, that is right, I said plight of EB2-India.
I am a passive observer of these forums. But some of the ridiculous notions floating around here have motivated me to vent. First and foremost, the law as written is highly favorable to people in EB3 categories, even from India. Here is how...
Take my example (and there are thousands like myself)....came to the US 8 years ago, spent 5 years working day and night to earn a PhD on a low (barely sustainable) stipend, got FIRST job saw decent money for the first time 6 years after I came.
Now, compare this to a person working an EB3-job for the last 8 years. Not only does this person do a real job that hopefully provides a respectable income but this person also has the option of moving to EB2 after 5 years of experience. So, at the end of the day in 2008; this person comes out ahead of me in terms of money, in terms of priority date (if ported) and most likely in terms of GC.
There are complaints all over the forum which have the stink of pretentiousness such as oh..i am a poor EB3 waiting for n number of years etc etc. What you guys seem to forget is that YOU are NOT an EB3, it is your JOB that is EB3. You have all the opportunities that were/are available to a person who sweated it out in the university system here to gain more qualifications and get an EB2 job. You CHOSE not to. The general discussion seems to center around cribbing about the US immigration system (Immigration by the way is a privilege defined by laws, not a birthright) and then blaming the EB2 crowd when they finally see the system implement the law as intended in the first place (horizontal spillover rules).
All these posts that refer to my career is over because my gc is delayed are nothing but a pathetic excuse. Law of supply and demand....if you have a skillset that is valuable, you will be fine with or without GC anywhere in the world. It takes a bunch of documents to remain here legally, all you need is a passport to go back if the system here seems so bad.
For all the attacks that are bound to happen, here is the fodder.....this is probably my first and last post, I havent contributed a dime to IV, will work here as long as I like it and if not, India is a great country and provides enough opportunities for any skillset !!

Almost all Hyderabad house hold has one or more members live in US, who save atleast 15l/year and invest a lot in homeloand which would translate into sustainable stability in AP,India.
Unless US govt. declares bankruptcy, AP real estate would not burst so it would be safe to invest in AP.....
I feel you guys are barking the wrong tree altogether. I agree that there will be a slow down in the real estate market. No question about it. But not the segment you guys are arguing abt. Only 10% of the NRIs can afford a house worth more than 50 Lakhs. I am being conservative here. So the upscale realestate market is not fueled by NRI money. Its the black money in india.
There is a lot of black money in India. Real estate bubble in india is definitely because of that money. It will not correct as much as US for sure!

I totally agree with supporting IV.
The question is none of the Admin fixes in last one year has helped EB3-I. In fact, it made our situation even worse.
it may look like it that it has made our situation worse. But it was never good to start with. The visa number flow was going to EB3-ROW. Now it is going to EB2-I. That is good since if EB2-I becomes current the flow would come to EB3-I as we have older PD people than EB3-ROW.
Nevertheless, EB3-I was always the last link in the chain and still is. Nothing has worsened or bettered. If anything can be good for us, it is the 5882 bill. Another thing that can help is removal of country quota. With so many EB2 people getting their GC, we are going to need to really work towards getting contributions for lobbying since the people who get the GC cannot be expected to help IV anymore. We always were at the bottom and are still at the bottom. We need to unite and work with IV so that we call can get what we want.

Yes, I have the same question. Everything is a good practice recommendation. That is confusing.
And I thought it was one year. Is it 6 months?
Hi,
I heard it is six months. But someone should clarify whether its 6 or 1 yr. And also it is really necessary to work for 6 months/1 Yr or not??

what if Obama does not win :) ..if something has to pass it will pass during this term. things and priorities change after a person gets elected. this is politics 101. I appreciate your optimism and if there is no spill over then EB3-I faces the worst case scenario. as usual the truth is somewhere in between. i.e. be ready for a long road ..if you get before that ..then good.
as others mentioned ..the only other thing you can do is support IV.

I follow politics too and politics is very complex for mortals like us. there are many obstacles for Obama ..his tax policies, some of the controversies and mr Rezko ..why do you think Clinton only suspended her campaign but did not close it completely ?
Guys,
It doesn't matter what the president wants to do as far as CIR is concerned. As far as CIR is concerned, George W begged it to be passed in both houses well before he became a lame duck. I don't see how the lawmakers on far right can come and align with the far left or even the lawmakers who are in the center. For the CIR to pass through without issues, Dems should control both houses with a big majority. Also, if you are thinking that Obama is going to win this, you are very well underestimating Mac. watch out for the GOP machine in the last 2 months and it will be a different ball game. Clinton lost because her campaign was over confident and by the time they realized they had a string of 10 bad states whose background does not suit her. Mac's campaign can't be over confident after they saw what happened. GOP is going to do its best to further divide the badly bruised Democratic party. Its few states that will decide this election and its difficult to carry states winning only the metropolitan areas. Obama won 5 counties of 90 some counties in OH. If his performance in general election is going to be the same, forget OH. Same situation in WV.
For now, I feel Obama is a great visionary and ideologue. No one knows whether he will achieve most of the things he is promising to do if he becomes the president. But he has been very logical and rational esp with the gas tax holiday. All said, he looks like a destiny's child. Imagine where he would have been if the Rev wright wreck came before the Iowa caucuses.
There are so many ifs and buts. our interests are best served with out the big vehicle CIR. If thats the only vehicle, we possibly are going to be held hostage.

Nothing was mentioned about H4's ability to work before because it has never been asked before as an agenda item for Immigration Voice. Yes, the inability of H4 visa holders to legally work has been discussed several times on this forum but no one has asked for it to become an agenda item or a goal for this organization before. Today it happened, and so I clarified that H4 related issues, the issues that affect only H4 are not a part of this organization. There are many agenda items that improve the situation of H4 spouses. Indirectly thru most of Immigration Voice goals, H4 spouses get benefit. And that is plenty of reason for H4 spouses to support Immigration Voice.
However, none of IV's goals have an item dedicated to H4 that benefit H4 only.
Goals of Immigration voice are listed on the homepage. Under item called "Immigration Voice Goals".
Ability to file for final stage of the Green Card even without visa number availability – this will provide tremendous relief during the long wait since it will allow applicants to transfer to jobs with an identical job description, travel freely, and allow their spouses to contribute to the economy.
Eliminate dependents from the employment-based immigration numerical quota – so that industry does not have to wait for green card employees while dependents use up an allotment that is meant for high-skilled workers.
Increase the employment-based immigration annual numerical quota and keep the per-country limit 'soft' – recognize industry needs and admit more high-skilled immigrants who enhance U.S. competitiveness and bring productivity gains for both immigrants and natives, raising the standard of living for the population as a whole.
Recapture previous years' unused employment-based immigration visa numbers from before FY 2006, and going forward make the recapturing process automatic – due to USCIS inefficiency visa numbers are lost every year even as hundreds of thousands of applicants wait, this would keep those visa numbers in the pool.
Allow applicants (a) with advanced degrees in Science, Technology, Engineering or Related Fields or (b) who have worked for more than 3 years in the US on H-1B, to automatically apply for adjustment of status and get their green cards without regard to the employment-based numerical quota – these workers enhance American Competitiveness.
Labor Certification Backlogs: Draw policy maker and DOL attention to huge backlogs in labor certification. Bring accountability and efficiency to DOL Backlog Elimination Centers - insist that BECs give clear information on case status and processing methods.
Immigration Processing (I-140/I-485) Backlogs: Draw policy maker and agency attention to huge backlogs in processing. Bring accountability and efficiency to USCIS Backlog processing - insist that USCIS give clear information on case status, pending security checks and the number of cases pending by category, national origin and priority date.
Convert all single-year H1-B, Employment Authorizations (EAD) and Travel Documents (Advance Parole) extensions to three year extensions – USCIS spends more resources issuing these interim documents than processing green cards in part because they must be renewed every year. Providing three year extensions would provide relief to both applicants and USCIS.
And yes, one more thing about H4 spouses:
A few months ago, we requested volunteers for Immigration Voice around DC, Maryland, Northern Virginia area. And we explicity said we need a volunteer to visit some offices occassaionally on behalf of IV, including lawmakers offices and offices of our lobbyists. H1s usually cannot take away 10-15 hours per week away from business hours (9-5) but H4 spouses can spare time during business hours to meet the lawmakers with out lobbyists a couple of times a week. We had one volunteer on H4 who worked very hard last year in DC but she was unavailable now this year for several weeks and is still not available these days and may not be available anytime soon.
Do you know how many of the hundreds of H4 spouses living in DC area volunteered to help?
Exactly 0.
So go figure, why this organization does not have any issues the directly benefit H4 only in its agenda item.
Thanks.
