The point is your whole attitude is wrong. First lets get one point straight. We are doing this country no favour by working here nor is this country doing us any favour by letting us work here. Its a mutually benefecial scenario. Since we are contributing to this society and following all there rules we are asking for immigration rights.
To ask for something, you must first believe that you deserve it. The illegal aliens belive in there cause (even thought they broke the law) that is one of the reasons everyone talks about there cause including the senators, president and the media.
People like you on the other hand seem to belive in taking handouts and nobody cares about such people. unless we belive we truly deserver it nobody is going to give a damn about us.

I believe once you use your AP for travel , you automatically comes EAD. If you are working for same employer with H1, then employer may have to inform uscis above status change (no big deal . i don't know if all employers are doing that) i don't think you can transfer your H1 after travelling on your AP. If you want to be in H1 status again all you have to do is leave country , get H1 stamped if expired and come back again. You will be in H1 status.

Below is the text for Waivers.. My understanding is that if end Client gives a letter to DOL stating that they don't layoffs due to this H1B and it is a temp. labor requirement etc.. It is still harsh considering anti-immigration climate.. What is feared asked in a Visa interview will be asked by DOL for extensions. So, H1B can't be on an auto-pilot mode..

There are questions commonly on the minds of many Murthy Law Firm clients, as well as the greater immigrant community, that involve the effect of reentry into the U.S. on those who hold H1B or L-1 status as well as having approved Advance Parole (AP) based upon pending applications to adjust status (I-485). The law pertaining to this situation is not clear and the result is confusion. Thus, many with both H1B (or L-1) status and AP find themselves faced with the difficult decision of how to reenter the U.S. after travel abroad. One must decide between reentering in H1B (or L-1) status, which requires that the passport have a valid H1B (or L-1) visa stamp or utilizing the AP document. AP does not require an approved visa at the U.S. consulate. Such individuals are concerned about the manner they choose for reentering, as this may affect their respective status in the U.S. Answers to many of these questions are in our MurthyBulletin article, Adjustment of Status and Travel : Your Questions Answered! (August 31, 2007), available on MurthyDotCom. However, even in that scenario, the employer would not seem to have any additional I-9 obligations, as the last document reviewed by the employer (H1B or L-1 I-94) would be unexpired. Also, the employee would be allowed to file for the H1B (or L-1) extensions even after entering on AP.
Parolees Resume H1B (or L-1) Status upon Admission or upon Approval of H/L Petition
The May 2000 memorandum clarified that an H1B (or L-1) nonimmigrant, who has traveled abroad and reentered the U.S. on AP "may apply for an extension of H1B or L-1 status, if there is a valid and approved petition." Similar Result if Employer Files H1B Amendment
The same effect would be achieved if the current employer files an amended petition. It can also be achieved if the individual works for the H1B employer, and later seeks to extend H1B status through a change of employer. Additionally, since the AP entry does not invalidate the approved H1B (or L-1) petition, the foreign national potentially could regain H (or L) status by traveling abroad and reentering with a valid H (or L) visa, and obtaining an H (or L) notation on the I-94 card at the port of entry. In these circumstances, the H (or L) status will be reinstated, giving one the benefit of continuing in that status for a length of time even if the I-485 ultimately is denied. Thus, when one wishes to maintain H1B (or L-1) status, which is often the case, this still may be accomplished, even if AP is used for entry at some stage in the process. This is particularly straightforward for individuals who have H1B (or L-1) status that will need to be extended shortly after their reentry into the U.S. The H (or L) extension, if approved, will put them back in H (or L) status, even if they last entered on AP. Guys , I think this issue has been discussed lot of times.
1) USCIS do not allot immigrant visas, It is alloted by DOS.
2) DOS needs a fix in the current EB laws to capture unused visa.
3) I am not sure if we can push any change in law, given the current Iraq war quagmire.
But I hope they speed up the overall application processing times, with all the increased Fee money they will get from July 30th (by investing money on IT).
Not sure USCIS keep up their promise with a large volume of applications. I came to know from immigration-law.com site that, 750,000 applications(yes,i'm talking about I-485) will be filed in this one month period. So, I'm really scared to imagine something good with such large volume.
We should fight for recapturing unused visas and EB visa reform.
Otherwise, we dont know how many more years we have to wait to get GC.

does soft LUD mean RFE is comming or does it mean there are just pre adjudicating. Seems like a lot of people who got a soft LUD on 485 recieved rfe. Are there any people who had a soft lud on 485 but did not recieve any rfe.

Such events cost money. If we have enough contributions, we can spend as per our budget of nearly $ 50,000. If not, we will have to cut back on the event spending and reduce the magnitude and size of the event.

Folks - another update on my case.
As i had been following up my case with the help from my Senator's office, they requested USCIS to give a written decision on my MTR.
Here is the written decision that USCIS gave
"On March 27, 2009, you filed a motion to reopen. You indicated the use of the applicant's ability to "port" under section 106(c) of the American Competitiveness in the 21st Century Act (AC21). The requirements were met and the motion to reopen was approved.
CONCLUSION: It is concluded that the grounds stated for denial have been overcome.
ORDER: It is ordered that the motion to reopen be approved. The Form I-485 is "pre-adjudicated" awaiting visa availability."
I hope this encourages people to go ahead with AC21

Deba I am in the same boat as you.....Did not get very clear information till date. But what I have heard is you can travel on AP, get married as long as you have "a" H1-B stamp even if its expired in your passport it should be OK for your wife to apply for H-4 using the latest I 797 approval notice.
To be on the safe side though I am personally considering going for stamping as I dont have much time to wait for an AP as my PD is July 02 and I feel I might get my GC real soon :-)

We all can certainly do one thing, we can write emails, letters to editors and media talking about our personal situations, highlighting EB visa backlog and how that is hurting legal-tax paying aliens like us. We can raise awareness in the media and we can bring new members.
When something is asked of us, we should do that. Pappu asked everyone to write to the editors thanking them for the story about immigrant entreprenuers. Just yesterday, we had some people come forward and write to all these editors.
Myself and some other members even posted names and emails of all the editors that we should thank in the "news article thread". If all of us can go there and write emails and flood them with thank-you notes, we will get noticed. Remember the print media business is based on how many readers they have, we have to make them feel that this issue is very important and is getting them more readers and membership.

I wish more people participated in it. infact if more members can continue to do it today it will be very helpful. yesterday there were at least 3 mails from reporters expressing interest in us. This was because a few people wrote to them about IV and requested them to do a followup article abut us. I had found about 72 articles yesterday morning and we had more than 50 potential reporters to contact.It is not easy to get press coverage and this is one opportunity where we can captitalize on the venture captitalist story (no pun intentended).

How true! In fact not only we have to maintain H1B to be able to "bring" spouses but we have to MAINTAIN H1B until the our PD becomes current to be able to maintain spouse's H4 status.
