I did a quick search and did not find answer to this. Apologise if this is a repost.
But a co-worker of mine wants to travel on AP. After coming back, he will join my company (right now he is a contractor) as a perm employee on H1. Is it possible and allowed? Can he transfer H1 after using AP?
Our company attorney confirmed that his H1B will remain valid even after using AP. But she is not sure about transfer. I will post her reply once she gets back to him. But in meantime, if anyone has any idea about this, please share.

Based on this poll, anybody with PD of Jun2002 onwards should consider Porting to EB2.

They can also make labors portable between employers ie the PD of the labor is portable irrespective of its state! But I hope they have that vision and wisdom.Also please make us apply 485 without the need to visa number.90% of our problems will disappear

How will it march steadily when we have less than 3000 numbers for the year?
I am sure we have many pplicants with PD in 2002 and 2003. I would be surprised if PD moves beyond April 2002 in FY 2009.
Assuming no other miracle happens!

My company got an RFE for ability to pay from USCIS. we are responding back with my companies 2006 tax returns and w-2 which shows more than proffered wage determined by Dept of Labor during PERM. I hope this should be fine and I will get a favorable response.
My concern is whether I should apply for 485 or should I wait till 140 approval to apply for 485.

Oh yeah .. but that is provided I can file my 485 by that time. Given my PD was just May 06, I had NO preparation for 485 filing, wonder how much time gathering up all the required docs takes for this filing :)

I received the exact same Email notice from USCIS as you on Sept. 28, 2007. I'm confused! I got my H1B 7th year extention approved in Feb. 2006. What happened to this case?
What are your priority dates? They may now be working on your GC application.

I have visitor insurance for my mother who is visiting us. Recently she developed some symptoms. The insurance company told us that since the symptoms were due to a condition that originated while she was in India, it is a pre-existing condition.
My advice to you all is to get a physical checkup for your elderly parents in India once in a while. At least you would know if there are any issues which come with old age and you can take an insurance covering those existing conditions.

No It was not a joke.
If you think you earn way more then go ahead and contribute more. I just put dollar amounts in front. Many desis here work at 55-65K per year and that is roughly $30 an hour. The ideas is get off your high horses and earn money through sheer labor to get the job of funds done. I see no problem with that.

Because I doubt that anyone willing to wash my car for a few bucks is highly skilled. Personally, I prefer, give 1 day of salary - that's way over $25, and far more effective (I get paid more than $25 for the time it takes to wash a car).

Folks - Our strength in numbers is going to matter in the end. 40 people calling the representatives is not going to cut it. We need all the registered members to come forward at this time and make these ever important calls. The whole process does not take more than 10 minutes. People in these offices are really nice and easy to talk to. They will note down your message and pass it on to the representatives. Most of them are not even asking for your name or phone number or address.
For all those who are content with EAD's or not content with EAD's, ffor all those who want to switch jobs or careers and can't, for all those who want to get GC's sooner than later, each one of us needs to stand up for himself/herself because if you don't, no one else will.

If these numbers are correct then total EB-I pending applications are about 125K only. Thats less than one year of total quota and If USCIS work properly then this backlog can be cleared in one year (ignoring ROW for now). But thats not happening and backlog is increasing every year, especially for India.
Howcome, USCIS reports that pending I-485 is 620249 as Jan'2009.
Something is wrong. I wish we can get pending applications per year per category.

Not true...
In the EB base, only 1 GC is counted for all family members. How can it count more than one if it is a derivative of an employment visa? It might count against the Family base even though primary applicant is EB-based. Not the other way around.
If they dont count Dependents we all get GCs very soon . Unfortunately all dependents even kids are counted under employement category ..
One change - Counting a number for primary applicant can change thousands of lifes each year .

You are absolutely right. there is no need to fight we are all in the same pool...There is no EB2/EB3. We are all people who are desperately waiting for our gc's and please we need to work together to have things solved...This post is not helping issues...but making worse.
