Dear Friends,
Got Green cards and Welcome notices for me and my wife .
Surprisingly no uscis e-mail and online status is still "initial review"
Our journey in short :
How long in US : 10+ years
First Labor in 2002 . Changed job in three years before approval of labor
Second Labor in 2004 . Approved in 2007
Filed I140 and 485 - in July 2007
Since then I was enjoying EAD / AP with no complain .
I donate to IV now and then , but for some reason only once (for few days) got access to IV-Donor Forum . But always had a faith that IV is doing good work .
From non-donor IV forums and other forums I noticed that USCIS are transferring leftover Visas to other EB categories . I waited to see some thing coming to EB3 but ......nothing came .
My Lawyer told me that I can port to EB2 and it is a normal a process.
1. New Perm
a. Filed in Feb and approved in 10 days ( Prep work takes 3 to 4 months before filing )
b. Requirement : 4 years Engineering + 5 years minimum experience
2. EB2 I140 (TSC)
a. Filed in March - Premium Processing
b. My Lawyer sent interfiling letter along with I140 filing
c. Approved in 7 days (A# and Priority Date retained)
d. Same week got Green Cards and Welcome Notices:) - Super-fast Approval
e. No email and no updates on USCIS website
Not sure about the USCIS and Lawyer fees . My company paid for every thing.
Hope every one get the desired freedom asap and don't have to wait like me for 10+ years

Fraud is not correct word, it is because of lack of policies or loop holes in the current Immigration System. This can be found in any system, any country, any people. So, there is no need to talk on that. It is better to put our EB related retrogression problems to Congress and no use in discussing these. Otherwise If you start discussing on fraud, every work done by everybody is going to have some kind of fraud. It is to survive and so people do whatever it is, with in the limits of law.
All people who are being labelled as socalled "Americans" came here like immigrats and theft the land from Native indians. So, everybody is doing wrong. That's part of time. So, no need to blame just few. It is being done by everybody. So, please skip the topic and focus on the our current problems.

Not being judgmental at all. This is a question that has to be posed to the HR department in the company and not to 'peers' on a forum. The profile says he/she is on EB2 and then he/she goes on to ask this
"let me know if they have done EB2 with this scenario." WTF! :D While I'm not against getting your degree online or IGNOU but you need to at least have the acumen to geo-locate yourself it nothing else :D Other skills are far superlative and come much later :D

This is a developing story. I am sure there are lots of IV members in H1 and getting/going to be affected. one of the option I am trying to explore is to take the USCIS and CBP to the court. They do not have the authority to decide the employer-employee relationship.

They do care about employees. They just can't handle immigration and visa issues. It is too complicated for a lot of employees. For a lot of employers, the term H1b visa or sponsership gives "jitters".
While a lot of employers look at things from their perspective, they do understand all issues that you face. It all depends on how important you are and if your absence would make a difference. If you are irreplacable, and employer thinks they must keep you at any cost, then they will do it, or you have to take care of yourself.

I am glad to see that is so much documented material out there that puts the rights of all individuals clearly regardless of immigration status.
I wish people would come forward and participate in efforts of their choice and speak up against unfair system, thru IV or otherwise, and not be afraid of getting fired and getting deported or being a victim of prejudice by USCIS just because they posted a thread on IV, or contributed funds or met a lawmaker to petition them for pains.
There are a lot of visitors of the site(who wont even register on this site) who have such apprehensions and doubts and posts like yours help clear those doubts and help them join this effort and strengthen our hands.

I hope that many more of us will step forward, we have a lot of rights but it is easy to forget that. you have a PD only if you are in a pool that has a restriction on the number of GCs that can be issued in one year. if you are exempt, basically you don't have a PD. That is, it is always current. You do wait for them to finish processing your I-485 for which there will always be a processing date, which may or may not be current for you.
Also, please don't give any such ideas to USCIS; they may like this particular idea :D
I hope USCIS has your thought process. Your thought process means that there is something in SKILL for US MS. I used to think that SKILL is only for non US MS.

What really baffles me is the attitude of some members in this forum. They contribute $20 a month (some dont even do that) and want to be treated as a Congressman , with updates & news flashes.
Get real people. First of all your contribution of $20 is nothing compared to what we are up against. We want to push for a change in law in a foreign country, which will impact generations of this country with a small contribution of $20.
The point being: If you cant run the show then shut up and watch it. Give your advise when asked for and dont pretend to own it.

Sen. Brownback(R) - Kansas
Sen. Hagel(R) - Nebraska
Sen Coryn(R) - Texas
They are from the so-called conservative states.
I haven't heard anything positive for our cause from senators from the so-called sophisticated/liberal states like Illinois (Dick Durnbin & Obama) , NY , MH (Kennedy and Kerry), CA (Boxer and Fienstein) for our cause. In fact they have gone towards family immigration and are screwing us in the process.
If you might notice that all these Senators who are coming up with these brilliant ideas are either from some god forsaken place in the US where there is nothing except a WalMart and a Church or the Senator doesnt know his economics right and is using VOTE BANK POLITICS parallel that to the recent Mayawati being elected in UP & AB & AMbani getting hit in scams and SEZs.

Innocent people always get hurt in a war. And in this conflict its the legal immigrants, who have not broken any laws, are the ones who are suffering the most. Senator Obama, as the President of the United States, what will you do, so that the voice of the people can be heard and their problems solved instead of selected powerful groups bullying the lawmakers?"
Please vote. We need have people talking about our problems. We need to bring awareness about the difference between legal and illegal immigration. The likes of Dobbs often confuse the two.

If you believe IGNOU or Univ of Pheonix are fraudulent, Please provide proof of this and also report to USCIS.
Its not purely education that will get you H1 or GC. You also need to be skilled in your field.
You might look down on certain universities or degrees but in the end employers care more about skill and experience and so does USCIS
Looks like you are one of the beneficiaries of H1 who does not have good education. You can console yourself with the word 'skill' and all that computer jargon The bottomline is H1B visa is for professionals. However, in the past few years, Indian IT bodyshops have sent underskilled computer operators to the US to enhance their operating margins. This will come to end very soon and has to come to an end very soon. I think the process has already begun. Number of H1b visas rejected at Indian bodyshops have gone up. Operating margins at Infosys has shrunk significantly. Infosys and other bodyshops have seen stock price plummet drastically.
Companies such as Congizant have stopped bringing people from India on H1. Rather they are trying to hire people in the US who already have H1B visas. The illegals who have gotton their H1B from shady consultants in NJ, CA and elsewhere. Congizant is doing community service by legalizing illegals. The people who sat on the bench during recession while holding their H1B visas without a paycheck. Sorry with paycheck which needs to be refunded to the employer by personal check. Stop the fraud, please stop the fraud.
