With Another Employer, Even After Entering US on Advance Parole.
I have a few Questions for you I would appreciate if you can please answer them :
1. When you Applied for H1B Transfer in Permium Processing, which I-94 #
did you gave to USCIS.
2. What did u or Attroney answered for Last Manner of Entry Question
3. Are you within the 6 Years limit for H1B or beyond i.e. using I-140 Approval.
4. Did u get any RFE for your H1B after using AP.
Please let me know.

In my case, I travelled back on AP as my visa extension stamping went pending in Mumbai consulate. Came back here with my I-94 indicating "Parolee" as my new status.
Within 2 weeks, I changed employer as per AC21, they filed for my H1 transfer(premium processing) via Murthy Law Firm. I received a new I94 which put me back in the H1B status. During this 2-3 weeks I was in the US as a parolee I did NOT use the EAD, because you don't have to.
Interestingly after 3 months of my visa application at Mumbai consulate (2 months after I reached US) I received an email from them asking me to submit my passport for stamping. Its unbelievable that they think applicants would still be waiting in India for 3 months and that their employers would still be interested in keeping them, but I guess after all this ordeal I realised, they just don't care.

How do I find out if there has been a Soft LUD? I have an online account on uscis.gov and the "Last Updated" fields are all in 2007 (when I filed my AOS).

I am finding Soft LUDs on all my old h1bs (from first one) over last 10 months. One of them is a hard LUD and it is about the previous employer revoking H1B. But there are Soft LUDs prior and later to that on other H1Bs. All H1Bs are from big / medium corps and no known status issues / violations. They havnt touched the 485s since FP date.

Read the article on today's washington post. I had to email the writer to get the website (email) information. He/She was nice enough to email me the website link. It would've been better if the website link was provided on the article itself, I think that would've directed few more folks to this site. Such events cost money. If we have enough contributions, we can spend as per our budget of nearly $ 50,000. I think US experience will hold good in canada, at at least in IT. Canadian experience matters for immigrants who directly come from their home countries, never having lived in north america before. The trick is to find a good enough job for your experience level .. what is the point of going there and doing the same kind of job that you were stuck with here ?. That is easier said than done given the limited size of the canadian IT industry. I second your thoughts if you do get a good job, an year or so should be good enough to establish yourself. I fact, I know a couple of guys from my area who moved to canada with their families to escape retrogression, and are now well-settled there with no intention of ever coming back to the US. But yes, it took a while for them to find those jobs.
I think rpatel is right. This what I heard from one of my buddies who moved to Canada in 2003 and recently got PR.

I am a LEGAL immigrant how has waited in the line for Green Card for 10 years. I've paid my taxes, social security, medicare and followed the law. Immigration bureaucracy and inefficiency at USCIS has meant more than 250K of Green Cards within legal limits have gone waste leading to a very long wait for legal immigrants.
Please tell me what I should do - Wait another 10 years? Go back to home country? or jump the fence?

These are small regulations that agencies can do. But even for such changes, the time period to get it done is very long (several months to a year). At least DOL woke up and acted. It will still leave a door open for sellers to stay happy and able to substitute labor. However it is not easy to find a buyer of a LC in 45 days.
All these are small problems compared to retrogression. Labor substitution rule will not get any visible or any noticeable relief to us. We will continue to stay retrogressed and wait for another 10-15 years for our greencards. It is important for us to contnue to fight to end retrogression by getting a legislative change done. As long as members are there to support IV, the organization will use every means to get relief measures for all of us. The coming months are crucial to our struggle. We need to stay united and continue the effort of making this organization a formidable force on the hill. IV members writing negative comments on various forums or feel disheartened should know that to get even a smallest job done is not easy. They are not only harming the whole effort and making anti immigrants happy, but also harming themselves by hurting this cause. Sometimes it is sad to read such negatve comments when you know how hard it is to work with limited time, resources, manpower and lack of much needed motivation in members.
BTW In our recent efforts we did give anti-immigrants shivers down their spine. It can be seen from their posts on their sites and also the hate mails they write on our forum and send to core members. You dont see a lot of it because we moderate posts. We are not scared of anyone. All this has only made our resolve stronger to fight it out and fix the system.
Hi pappu, in the mainstream life and based on how things work in the United States or any other country, do you think we must actually care and scare anti immigrants? Do they really have the clout? What is their basis of opposition? Do they have a strong lobby? What is the basis of their lobby? it is eviddent that politicians tend to be easy on them because they are citizen and vote and they have to listen to them, but otherwise, do we really put ourselves and our efforts on par with these junk organizations?? Are they any progressive groups? Do they have people with great minds and innovative ideas?

Don't forget there are a few H1Bs who are hired in research, govt, non profit, universities, etc who do not come under the H1B quota. Even they want GCs, :)

yes. I honestly do. Having been through multiple recruitment attempts, at three different companies, in the bay area of all places: there are simply not enough qualified/interested american citizens available.
H-1b is not cheap labor. American companies prefer to hire H-1bs with US master's degrees or with substantial amounts of US experience. When they do hire foreigners, they do not discriminate against them by paying them lesser.
H-1bs are abused by desi vendors and the like who take advantage of the indenturing nature of the visa and also on the naivety of "fresh off the boat" people who newly arrive into the US and are unfamilar with US economy. They are starry eyed, still busy converting each dollar into their local currency and feeling happy they are earning relatively more and dreaming about paying off their EMIs back home, sooner. It takes quite a few months for them to settle down and understand US dynamics.

Lastly, we should not confuse the need for H-1bs as equal to the need for GC holders. Take the example of middle eastern countries. They use foreign labor, but they never grant them permanent status. That way, they do not get stuck with them in the event of a downturn. American could have chosen to follow a similar model. Use H-1b temps when necessary and send them out when they are expendable. They have no reaons to hand out GCs, like I said earlier. The benefit is all ours.
good point. However unlike the kind of work being done in the middle-east, there are a ton of companies in the US founded or co-founded by immigrants. There is a reason this place is called the land of immigrants. Handing out GCs gives these people options to start companies and many many of them do. this creates jobs, creates more intellectual capital, all within the US. In 6 years if you make a cook in Dubai leave and go back to Kerala (just picking a typical example) he is not going to do anything to compete with Dubai. You make these H1-Bs who have spent 6 years here (working on various products, technologies, ramping up, understanding customers, relationships etc) go back, they are going to start companies in India. Now all the capital stays out there. The same 5 products that could have been built in the US and sold to lots of companies abroad, will now have to be bought by the US.
If there is any kind of immigration that I think the US does not gain much from, its the diversity lottery and to an extend the chain migration that comes from family based immigration. EB immigration is a BIG win for the US economy.
