My fear came true today. USCIS issued a RFE for my wife's I-485 TB test and she is in India right now. RFE has May 6th deadline and she would be back on June 3rd.
What are our options?
Request an extension for RFE?
Pre-pone her trip? (this would be really a costly option for us...since we have so much planned around that date)
Do TB test in USCIS approved surgeons in india (If there is any)

Please check the website of the US consulate of the particular region of India where you reside, like delhi or chennai etc, and or call their information line. They would have local hospitals or Medical examination certification centers that are designated by the consulates as being eligible for providing medical certificates, especially for people with Consular Processing interviews. I guess, that could probably help. Consult your lawyer or take an infopass to verify this information accuracy. Thanks. Sree

IV managed to fight its way through the July visa bulleting fiasco and compelled the USCIS to honor the original bulletin. Even after witnessing such a huge achievement if some people are making comments like they would like to weigh IV's worth before deciding to make contributions then they can be classified as perennial skeptics.
Visa bulletin after visa bulletin is putting us into a spiraling depressive state. IV is the only organization which is interested in solving this retrogression mess affecting highly skilled immigrants.
Make IV a paid subscription organization at $50 membership fees per annum. It is better to have 10000 members who can surely generate half a million dollars in revenue, rather than 25000 members who take about 8 days to generate 30000 in funds.

I finally get the chance to share our wonderful news with you all. We (me and my wife) received our "Welcome new resident" e-mails this morning.
11 yrs for me and 12 yrs for my wife since coming to the USA. Between the two of us, Three J1s and Two F1 stamps, Six H1b stamps, Four 140s, 10 EAD/AP (5 each), 3 finger print notices apiece, Four RFEs between us and a total of $68KUSD in total USCIS fees/Lawyer fees and countless gray hair later and after many an emotional roller coaster over the years, it was our turn today.
For those of you unclear about the admittedly weird above numbers, take a look at my RD. It is not a typo! I often wondered if I was a lone Dinosaur that survived the meteorite. I never saw anyone with a 4 plus year 485 recently.
Our 485s were 2 yrs old and approvable when the visa bulletin fiasco happened in summer 2007. Ironically I heard that even my FPs/Background check were cleared by then (which in those days was the main cause of delays).
I made many approaches over the years to the USCIS via phone, email, and fax, My Congressman contacted them on multiple occasions (atleast 3 times when he forwarded their response to me). I finally also wrote the ombudsman 2 weeks ago. I was pretty scathing in that letter as well (about their mockery of their stated FIFO policy etc). I am not sure exactly what worked, or if anything at all did, and it was just my time. After a while dealing with the injustice, you just get numb. Today finally I breathe a deep sigh of relief. The loooooong wait is over.
I've spent so long waiting I even get nostalgic about the early days. I will continue to stick around here and do what I can to help with IVs efforts. I believe with our overall effort, we are helping ourselves yes, but what we are advocating for is correct for this country as well.

Came to USA on H1B, paid for the H1B fees(at that time didn't know it was illegal to do so)
however after coming here , Paid for my own ticket and landed here on start of january 2011.
I am a little doubtful...if this was illegal.
Since you had no knowledge at the time that it was illegal.
Being a foreign national you may not be expected to know every law here.
How much did you pay? was it more than what the fee was?
Did the employer processes your visa or did they use the services of an attorney?
if you...then you have a case to sue the employer for scamming you in civil court...as he may have used this trick to eat your money knowing fully well what would happen to you once you landed here.
Talk to an attorney here before you leave.

There are many deep pockets and if there was any such arbitrague existing people will mint money all day long. Rupee is not fully floating currency that doesn't mean you can control what the exchange rate is going to be. No company or congolmerate can manipulate market like that.

Compared to MBA if you invest these three years and 50 K in a business wouldn't you be better off?
An MBA from an accredited AACSB university is a good investment for the long-term. However most such schools require a good GMAT school, require 2-3 years of part-time classes and cost anywhere between 30k-50k. But then there are people who are already in their late 30s or early 40s who go back to school to get an MBA. So age should not be a factor for higher education if you are in your mid-30s,

In the final rule making process, there is no comment period before the rule takes effect. On the date when the final rule is published in the federal register, it becomes a binding rule and the rule-making process is complete. Certain provisions in the final rule may take effect on certain specific later date or dates, but the rule itself becomes a binding law on the date of publication of the rule in the federal register. Accordingly, unless the DOL changed the proposed rule, substitution of the beneficiary of the labor certification will be eliminated on the date of publication which includes the substitution of the beneficiary in the pending labor certification by amendment as well as the substitution of the beneficiary in the approved labor certification. For those who filed the substitution I-140 petition, the proposed rule provided that only "substitution approved" on the date of publication of the rule would survive. Substitution approved can be interpreted to mean approval of the substitution I-140 petition. For the 45-day validity of the certified labor certification, under the proposed rule, the certified labor certification on the date of publication was supposed to have 45 days to file the I-140 petitions. For the labor certifications which are approved after publication of the final rule must file the I-140 petitions within 45 days from the date of certification.
