eb3_nepa's request is valid in the context that spouse of an L1 can take up any Job.. & the spouse of the proposed 'Blue Card" can take up any job.. why not a H4?

On the other hand for those ones that say that we (H-4s) could apply for H-1B easily, it is not easy if you are not in IT. I second this post.
My post is going to make few MS/Phd people angry over here. Correct me if I am wrong, but when you came here to do MS/Phd, you came on a student visa...Right? Student visa comes under Non Permanent Non Resident alien category. All of you had a burden to prove to the US consulate that after you complete your degree, you would go back to your home country. All of you prepared for that and you knew the moment you said, I might not come back, F1 would be gone! You said this...every time you went back for F1 visa revalidation. Mind you..that H1/H4 never had that burden. They could have easily said that yes, if I like USA, I might not come back.
Now fast forward....MS/Phd is done. Suddenly...."I will go home after MS/Phd" statement is gone..and hunt for H1-B is on! Once they get H1-B, hunt for Green Card starts. Once this heavy head Phd guy, who spent last 5 years on 1500 bucks a month is in GC line....he also realizes that hey, H1-Bs should not be allowed to interfile. After all, they all work for desi consulting companies. Yeah..right! Look who is talking! All H1s should come in EB-3, after all they did not go through 1500 bucks a month for 5 years.
Here comes a Phd guy who always lied to the system saying "I love my home country, my research would do wonders to the society at home" is not leaving any stone unturned to get his GC (faster than anyone else).....tell me, who is inferior? A Phd student who lied to the system for 4/5 years and suddenly changed his intent or an H1-B candidate who never had the burden to prove that he would go back.
All of us are part of this very painful journey! I have spent 8 years on H1-B and I am still waiting for my GC. I work for a desi consulting company, my GC is in EB-3, I have a B.Tech. degree from IIT and I am sick and tired of this GC mess.

Agree with macaca, It is not fair to expect a member to contribute the moment s/he joins.
Suggestion: IV membership should be free for the first 3 months, after which there should be a minimum $20/per month to keep your membership and log in.
Also at that time a member needs to update his/her profile to include contact information. This way we encourage new people to come study the issues, gain trust with IV and IV gets real people with real names that can be contacted if and when there is a need for mass-campaign.

Generally there are lots of people getting affected. But there is no one to lead the fight. I am sure once we start people will come and join. I am in the process of contacting the attorneys and consulting companies to fight together. I am also hoping for IV core to come forward and give us direction on this. I am ready to lead and fight. You are missing the point and no i am not kidding. i know you guys are angry that people are not contributing( i am monthly). People have money but they dont care they want a free ride, you cant put your hand in their pocket and amke them pay. The point i am trying make is that instead of complaining we can try and do something positive. There are many ways of contributing.
Getting contributions is always depressing. people will listen but the like watching from the side lines. If have knocked many doors people listen, few act, thats human nature. They like to support winners not strugglers. if you look at the funding patterns of other groups you will find out that they are being funded in a big way by companies or a couple wealthy individuals with an agenda. We on the other hand consist of people who are directly affected by retrogression. Sadly, once (many) deisis get their GC's or become sucessful they wouldnt spend 10cents on our efforts.
i took a couple of days of during the december debacle and called each senator in the list. i email any and every one i know, nothing happened, i felt helpless for a couple of days, then got back to normal.
My IM has a header/identifier that mentions IV, if you have a 50 odd people from your office etc on your IM i am sure 15-20 might visit the the site and a few might even join in. Most of them will ask you about IV. If each one of us can do something little, maybe something positive might happen and most of all the core team can worry about the big picture instead of monitoring threads or provided updates every hour and foucs on their long term efforts.
What is not productive is bitching and moaning about issues like who caused, the mess, how desis screw up and the like....

Everyone in this forum makes good money than an average American and in fact per capita income of Indians in United States is much higher than the per capita income of this country; yet only 2.5% of the people chose to contribute. That shows the resolve of this community to get any kind of relief yet we all complain why illegals get preferential treatment. Because they are vocal and determined to get some relief. They come out in large numbers all over the country to protest and make their voices heard and here we can hardly find anyone willing to tell their story to the media.
In conclusion, it's not that we don't have the money .. we are not willing to contribute and are too busy questioning IV's motive and financials. We would rather pay 20k for sub labor than 20 dollar for IV and this is the attitude which will take us no where in terms of any relief for legal community. God help us all.

Can I add my spouse before or After marriage?I am planning to get married in 4 to 5 months.My attorney told me that he will be ready to file I-485 in July and my current H1-B is valid till Dec 2007,so if I go back to country for marriage and coming back on AP,so I think so I will be ok,but should my wife able to get H-4 visa stamp on her passport and once she came back in USA on H-4 should I will be able to add her right away in I-485 when PD dates will be current or should I have to wait 60 days then apply her for I-485.

The story of memorandums is like this. If present law does not have provisions for certain things, then the government departments can publish a memorandum to give some kind of legal basis for their actions. Publishing a memorandum itself is enough to conclude that current law does have provision as such.
Usually these kind of memorandums are made against people who are vulnerable and do not have avenues/options to challenge. There were several memorandums made against undocumented workers not long time back. None of them stand the judicial scrutiny when challenged. Example, there was court ruling in many states that police cannot ask people about their immigration status.
The intentions of this memorandum is clear not to give any more H1Bs to small consulting companies.
I do not understand why some people in the forum have so much anger against the small consulting companies? This is just playing into the hands of anti's . Consulting through multiple layers is perfectly legal and a successful business model. No company wants to hire a person for 6 months project. It's been the goal of anti's to make small consulting companies look bad and they have been successful because of us. If this business model is bad, why not make laws to stop this type of business practice? If you ban that type of business, there will be no need for small firms hiring H1Bs.

This is becoming a messy going forward ...we are keeping hopes that it will be better next month.....so far our hopes are left over as hopes only...
Yes, due to CIS lack of capability they have wasted thousands of visas, that is not our fault then why we are suffering......we have been working hard and contributing this economy in all the ways......then why can't we treated to get our legitimate benefits??????
We have wasted/spent years and year here by treating US as our home country....hopeing one day we will get our GC.....but now the way things are moving ..totally we lost our destiny.....and for me (I am sure quite a few out there too) it is not that easy to go out and start the life from scratch again...
IV should stand up and do something...we are with you.

The new generation thought stock market is for educated people where you understand the company principles/profits/analysis etc... But it is turning out more like GAMBLING.

I am from Bangalore. Most of the major cosmopolitan cities prices will remain stable(10-15% changes) . If you are looking at long term investment, go ahead and buy LAND.
After 5-10 years, you can sell and use it for your kid's education or you can construct
rental houses.
Make sure the LAND documents are correct and there is proper security for it.

Longest I have seen a 485 denial go without getting reopened is 5 months.
If a person doesn't have h-1b then six months is a magic number. If person overstys six months and uscis ultimately denies it again then person is in terrible situation (3 year bar).

There was a company change change with same dba xyz ... in year 2001,(means employer close the company and open another one with different name at same location)
Same Owner and same business location so company file two taxes for company 1 and company 2
Company 1 2001 tax return shows net income of $25,500

company bank account also shows over 100k in 2001

Yes you can do that. But you work late coz people Not dependant on H1B's can leave on their scheduled times coz if they get laid off, they wont be deported if they dont get a job in 10 days. Sure there is No Formal distinction on paper between H1B's and Non H1Bs, but it is assumed that since ur application depends on the employer (entirely), you will put urself to the grind.
You could easily get a legal immigration if you opt an easier path 'Marry a local'. So, again you have opted a hard way of going through labor certs, I-140, I-48 etc.
What about people who come here already married? Now for those unmarried you have to marry a Citizen to get a Green card. Marriage is a totally seperate thing and is not something that should be used solely for getting a GC (IMHO). Sorry but i do not agree that marrying a citizen is an easier way of doing ur immigration.

paskal - i actually agree with your basic premise.....once the larger body agrees on a basic vision and strategic plan - the tactical manuevers to achieve the vision in line with strategy should be left to leaders.......
but this principle generally works in two scenarios - either when the leader (or lead group) is appointed by a higher authority (like employees following the lead of a CEO appointed by board of directors which in turn has been "elected" by shareholders) or when the leader has been directly or indirectly elected by the constituents.......
Let me give an example.......an entrepreneur starts a company with a great idea.....grows it and nurtures it with great love and passion......dedicates his whole life to the idea and the venture.......then the entrepreneur needs a larger canvas and more money to grow the vision further.......he takes the company public or gets private equity funding or raises debt........now the new owners/ stakeholders decide they need to change the management and decide to elect a person of their own choice........suddenly a rank outsider replaces the entrepreneur as CEO........the new CEO now has the legitimacy and owners' backing to dictate how the company should function.....

paskal - i actually agree with your basic premise.....once the larger body agrees on a basic vision and strategic plan - the tactical manuevers to achieve the vision in line with strategy should be left to leaders.......
but this principle generally works in two scenarios - either when the leader (or lead group) is appointed by a higher authority (like employees following the lead of a CEO appointed by board of directors which in turn has been "elected" by shareholders) or when the leader has been directly or indirectly elected by the constituents.......
